פסק דין
1.בעתירה שבפנינו מתבקש בית המשפט להורות על החזרת רכבו של העותר לחזקתו, לאחר שעוקל ונתפס במסגרת הליכי הוצאה לפועל. העותר טען כי הרכב פטור מעיקול בהיותו רכב נכה שנרכש בסיוע המוסד לביטוח לאומי.
2.מהעתירה עולה, כי העותר הגיש בקשה דומה לרשם ההוצאה לפועל בחיפה (מר שי גור), אשר נדחתה. העותר הגיש בקשה לעיון חוזר, בעקבותיה החליט רשם ההוצאה לפועל להפחית את גובה ההפקדה שהתבקשה כתנאי לשחרור הרכב לסך של 4,000 ש"ח. במסגרת החלטתו של רשם ההוצאה לפועל ניתנה רשות ערעור לבית משפט השלום.
3.מדברי העותר עולה, כי ערעורו לבית משפט השלום נדחה, ועל כן הוא עותר לבית משפט זה (יצויין, כי פסק דינו של בית משפט השלום לא צורף לעתירה).
4.הדרך הנכונה לתקוף את פסק דינו של בית משפט השלום היא בהגשת בקשת רשות ערעור ל בית המשפט המחוזי, ולא בהגשת עתירה ל בית משפט זה.
משעומד לעותר סעד חלופי, דין העתירה להידחות.
5.העתירה נדחית אפוא על הסף.
