הנשיאה ד' ביניש:
העתירה שלפנינו אינה מגלה עילה להתערבותו של בית משפט זה. המשיבה 2 מקיימת מפעל באזור תעשיה בבאר-שבע על פי התכנית שבתוקף קרוב ל-60 שנה. העותרות מבקשות לקיים אזור מסחרי בקרבת המפעל, והמשרד לאיכות הסביבה, על פי חוות דעת מקצועית, בדעה שיש להרחיק כל פעילות מסחרית למרחק של 300 מטר מגדר המפעל כדי לא לסכן את הציבור הרחב, עקב הסיכון הנובע מהחומרים המצויים במפעל.
בא-כוח המשרד לאיכות הסביבה הבהיר בתגובתו כי אינם יכולים לפקח על המתרחש בתוך המפעל הפועל על פי היתר הרעלים המסור לו. אין המשרד מתנגד לכך שהחומרים יוחזקו במרחק כזה מהגדר שייתן טווח של 300 מטר להגנה מפני הסיכון, אך אין באפשרותו לפקח על הרחקת החומרים מהגדר באופן המבוקש, ומנגד למנוע מהמפעל לנהל את סדרי עבודתו בעניין זה בתוך השטח שבחזקתו.
העותרות פועלות ללא ליאות ותוך ניסיונות התשה של כל המוסדות הרלוונטיים כדי להשיג את ביטול ההנחיה שאין לקיים פעילות מסחרית במרחק של 300 מטר מהמפעל. בקשתן נידונה מספר פעמים בוועדה המקומית לתכנון ובנייה, בוועדת הערר ובעתירה מנהלית. כל עוד אין שינוי של הייעוד מתעשייה למסחר באזור המבוקש, וכל עוד עמדתו המקצועית של המשרד לאיכות הסביבה עומדת בעינה על יסוד חוות דעת מקצועית חד-משמעית, אין לעותרות עילה כדי לחייב את המשיב 1 לסטות מעמדתו כפי שהוצגה לפנינו.
