הנשיאה ד' ביניש:

בדיון שהתקיים לפנינו היום ביחס לתפיסה צבאית של שטח להקמת אנטנה סוללרית על אדמה שהייתה מעובדת, והעותר טוען שהיה זה עיבוד שלו ומטעמו, התברר כי תפיסת הקרקע והקמת האנטנה במקום לקתה בפגמים לא מעטים.

בתגובתה המקורית של המדינה לעתירה שלפנינו נטען כי הקרקע נתפסה לצרכים צבאיים עקב העובדה שמדובר באזור הסמוך לכביש 35 (הכביש המכונה "חוצה יהודה") שהינו כביש מועד לפיגועי טרור והיו בו פיגועים לא מעטים, ולפי הנטען היעדר קשר בקטעים מסוימים של הכביש, היווה מוקד סיכון למשתמשים בו. לכאורה, טענה זו, כשלעצמה, מעלה טעם מוצדק ובלבד שהמקום שנבחר להקמת האנטנה הוא גם המקום המתאים ביותר מבחינה טופוגרפית ובהתאמה המירבית לצרכים. המדינה אכן פרטה שלא נמצא מקום מתאים יותר ובהיעדר אדמות מדינה באזור כל מקום סמוך ומתאים הינו בעיבוד פרטי.

שמענו היום כי השטח שנתפס הינו שטח של 180 מטר, ובאת-כוח המדינה הצהירה כי אין מניעה לעיבוד חקלאי של השטחים הסמוכים לאזור האנטנה. מטעם זה ובשים לב לכך שטיעוני המדינה בעניין זה נתמכו בתצהיר של סגן מפקד החטיבה המרחבית, לא ראינו עילה להתערב לביטול התפיסה.

עם זאת עולה מתשובת המדינה התרשמות קשה מהטיפול הרשלני שנעשה באופן תפיסת הקרקע ובקיום ההליכים החוקיים הנדרשים. צו התפיסה פקע בדצמבר 2009 ולא הוארך. רק לאחר שהוקמה האנטנה התברר, לפי הטענה, כי לאנטנה יש גם צורך אזרחי וטרם נבדקה האפשרות להפקיע את הקרקע לתכלית זו, ובעניין זה מתקיימים עתה הליכים.

עוד נטען בפנינו כי לא הוברר אם השטח שנתפס אכן עובד בידי העותר או בידי שכנו הטוען לזכויות בקרקע. לעניין זה הובאה ראיה לכאורית מטעם העותר כי החלקה בבעלותו או בחזקתו לפחות. אם אכן כך הדבר, יש מקום לפצות את העותר כספית בשל הפגיעה.

אשר על כן אף שראינו לדחות את העתירה, אנו רואות לחייב את המשיבה בתיקון כל הפגמים שנפלו בהליכים בתוך 3 חודשים. רשמנו לפנינו את הודעת המדינה כי אין מניעה לעבד את השטח הסמוך לאנטנה שהוקמה.

לפיכך, העתירה נדחית. טענותיו של העותר ככל שתהיינה לו כאלה, ביחס לאופן תפיסת השטח והמשך החזקתו, בחלוף שלושת החודשים, שמורות לו.
