המשנה לנשיאה א' ריבלין:

1.עניינה של העתירה שבפנינו, אשר הוגשה לבית המשפט לפני כשש שנים, הוא עליית מפלס המים בחלקו הדרומי של ים המלח, דבר אשר מסכן את בתי המלון המצויים באזור. הסעד המרכזי שנתבקש בעתירה הוא כי יצא מלפנינו צו המורה לממשלת ישראל לאמץ אחד מפתרונות הקבע לבעיה זו. ביום 14.4.2011, לאחר שהתקיימו שישה דיונים בעתירה, והמדינה עדכנה את בית המשפט מעת לעת בדבר התקדמות הטיפול בנושא מבלי שנמצא פתרון קבע של ממש לעליית מפלס מי הים, ניתן בעתירה צו על-תנאי. הצו הורה לממשלת ישראל לנמק מדוע לא תקבל בתוך שלושה חודשים החלטה המאמצת את אחד משלושת פתרונות הקבע שהוצעו ומדוע לא תפעל להשלמת פתרון הקבע שייבחר. ביום 1.1.2012 התקבלה החלטת ממשלה מספר 4060 שכותרתה היא "ביצוע פרויקט הגנות קבע בים המלח ומימונו והגדלת התמלוגים המשולמים למדינה (להלן: החלטת הממשלה). במוקד החלטת הממשלה מצוי אישור ההסכם שכרתה המדינה עם חברת מפעלי ים המלח (המשיבה 8 בעתירה זו), אשר קובע כי האחרונה תהיה אחראית לביצוע "קציר המלח" הנדרש לבלימת עליית מפלס מי הים.

2.נוכח החלטת הממשלה, סבורים המשיבים 1-7 כי המדינה בחרה בפתרון של קבע לבלימת עליית מפלס הים, בדמות קציר המלח, ועל כן העתירה התייתרה ויש למוחקה. מנגד, העותרת והמועצה האזורית "תמר" (המשיבה 10), מתנגדות למחיקת העתירה ומבקשות כי הצו על-תנאי יהפוך לצו מוחלט. לטענתן, החלטת הממשלה מהווה התקדמות משמעותית בדרך לבלימת הסכנה לאזור דרום ים המלח, אך היא אינה נותנת מענה שלם וסופי לכל דרישותיהן. בין השאר, נטען כי לא נקבעו לוחות זמנים ברורים מספיק ליישום קציר המלח וכי לא נקבעו סנקציות מספקות לאי-עמידה בהם; כי לא הובהר מיהו הגוף האחראי על עבודות משלימות הנדרשות בנוסף לקציר המלח; וכי לא נקבע מנגנון פיצוי לבתי המלון עקב "ירידת ערך" הצפויה להיגרם להם. חברת מפעלי ים המלח, מתנגדת אף היא למחיקת העתירה, מפני שלטענתה נדרש פיקוח של בית המשפט על יישום החלטת הממשלה בכדי לוודא שהיא לא תבוטל בעתיד.

3.סכנת ההצפה המרחפת מעל בתי המלון באזור דרום ים המלח הובאה לידיעת ממשלת ישראל בשנת 1971, עוד בטרם הסתיימו עבודות הקמתו של בית המלון הראשון שהוקם באזור. אף על פי כן, רק בשנת 2012 (בתום 41 שנים) החליטה ממשלת ישראל מהי הדרך שבה היא מתכוונת לטפל בבעיה זו, וזאת רק לאחר שניתן צו על-תנאי בעתירה זו. נוכח פרק הזמן הבלתי סביר בעליל שחלף עד שהממשלה החליטה מהו הפתרון הראוי, אין זה מפתיע כי כל הצדדים האחרים לעתירה חוששים כי יישומו המלא של הפתרון איננו נראה באופק. חרף זאת, במוקד העתירה עמדה דרישת העותרת כי המדינה תחליט מהו פתרון הקבע בו היא בוחרת, ודרישה זו באה על סיפוקה אף כי באיחור ניכר. מטבע הדברים, החלטת ממשלה אינה נוגעת בפרטי הפרטים של הדרכים המעשיות ליישומה, אך לעת הזו, ניתן אך לקוות כי המדינה תדאג לכך שפתרון הקבע עליו החליטה הממשלה ייושם במסגרת לוחות הזמנים שנקבעו. הטענות החדשות שבפי הצדדים אינן חלק מן העתירה, ומכל מקום, על הצדדים הנוגעים להעלות את טענותיהם בפני רשויות המדינה הרלוונטיות. ניתן לקוות כי המדינה כבר נתנה דעתה לסוגיות שמעלות העותרת והמשיבות 8 ו-10, או לכל הפחות כי תהיה מוכנה לתת להן פתרון משביע רצון. במידה שתקווה זו תתבדה, ואם המדינה תשתהה בביצוע מסקנותיה שלה, ניתן יהיה להגיש עתירה נוספת העוסקת בסוגיות הספציפיות שנותרו שנויות במחלוקת.

אשר על כן, העתירה נדחית.

בנסיבות העניין, המדינה תשא בהוצאות העותרת בסך 40,000 ש"ח.
