השופט ס' ג'ובראן:

עניינה של העתירה שבפנינו בבקשת העותרת, כי נורה למשיבים 1 ו-2 ליתן טעם מדוע לא יעמידו לדין את בעלה של העותרת, הוא המשיב 3.

כפי העולה מן העתירה, ביום 19.9.2007 הגישה העותרת תלונה למשטרת ישראל כנגד המשיב 3, בטענה כי איים עליה ותקף אותה. בעקבות הגשת התלונה הגיעה ניידת לביתם של הזוג כדי לאבטח את העותרת, כך שתוכל להוציא את חפציה מהבית. ביום 25.9.2007 שוב נשלחה ניידת לביתם של השניים, כדי לסייע לעותרת להוציא בבטחה את יתר חפציה. בהמשך היום הגישה העותרת תלונה נוספת כנגד המשיב 3, בטענה כי איים עליה במעמד הוצאת החפצים באותו היום. לאחר בחינת תלונותיה של העותרת וחקירתם של המעורבים באירועים על ידי המשטרה, הועבר חומר החקירה לפרקליטות מחוז חיפה, ולאחר בחינת החומר הוחלט בפרקליטות על סגירת שני התיקים, בשל היעדר ראיות מספיקות.

ביום 31.12.2007 הגישה העותרת ערר על ההחלטה לסגור את התיקים. ביום 11.12.2008 הודיע המשנה לפרקליט המדינה לעותרת כי הוחלט על דחיית הערר.

מכאן העתירה שבפנינו.

לטענת העותרת, ההחלטה לדחות את הערר נסמכה על עובדות לא נכונות ועל פרשנות לא נכונה, ותוך התעלמות מוחלטת מגרסתה לעומת מתן אמון מלא בגרסת המשיב 3. לטענתה, ההחלטה נתקבלה בחוסר סבירות קיצוני, המצדיק התערבות בה.

מנגד טוענים המשיבים 1 ו-2 כי דין העתירה להידחות הן על הסף והן לגופו של ענין, בהיעדר עילה להתערבות בהחלטה לדחות את הערר.

לטענת המשיב 3 דין העתירה להידחות, בהיות התלונות עלילת שווא המכוונת לשימוש במסגרת הליך אחר אותו מנהלת העותרת כנגדו.

לאחר עיון בעתירה ובתגובות המשיבים, מצאנו כי דין העתירה להידחות על הסף, בהיעדר עילה.

הלכה ידועה היא, כי בית משפט זה, בשבתו כבית המשפט הגבוה לצדק, לא יתערב על נקלה בהחלטותיהן של רשויות אכיפת החוק בעת הפעלת הסמכות הנתונה להן לגבי חקירה פלילית והעמדה לדין. התערבות מסוג זה תיעשה רק במקרים חריגים, בהם יימצא שההחלטה לוקה בחוסר סבירות קיצוני, נתקבלה תוך שקילת שיקולים החורגים מגדר הסמכות שהוקנתה לרשות, או מביאה לעיוות דין מהותי ויוצא דופן (ראו, למשל, בג"ץ 608/05 יעקבס נ' משטרת ישראל (לא פורסם, 10.3.2005)). בענייננו, העתירה אינה מגלה כל עילה להתערבות בהחלטה לדחות את הערר או בהחלטה שלא להעמיד לדין את המשיב 3.

כפי שעולה מתגובת המשיבים 1-2 ואף מהעתירה עצמה, תלונותיה של העותרת נחקרו ונבחנו בכובד ראש, תוך הקצאת המשאבים הראויים לשם הבטחת שלומה. בסיומן של החקירות לא נתגלתה תשתית ראייתית שיש בה כדי להצדיק הגשת כתב אישום, ואין בעתירה דבר שיש בו כדי להצביע על חוסר סבירותה של מסקנה זו. לפיכך, לא עלה בידי העותרת להראות כי נפל פגם כלשהו בהחלטה לסגור את תיקי החקירה, או בהחלטה לדחות את עררה.

אשר על כן, דין העתירה להידחות על הסף.

בנסיבות הענין, איני מוצא מקום לעשות צו להוצאות.
