העותר הינו פעיל חמאס בכיר – כך עולה מן החומר החסוי שהציג המשיב בפנינו – בהסכמת העותר. שוכנענו כי אכן קיימת סכנה לפגיעה בבטחון האזור – אם ישוחרר העותר.

העותר סובל ממצב בריאותי רע; הוא מקבל טיפול שוטף במסגרת מעצרו אך רופאיו סבורים כי עליו לעבור טיפול כירורגי להטבת מצבו ועל מנת למנוע הרעה. העותר מסרב לקבל טיפול כזה במסגרת שרות בתי הסוהר, אך לשאלתנו השיב נציג המשיב כי טיפול כירורגי מן הסוג הזה ניתן במסגרת בית חולים ישראלי מחוץ לכלא. מן הראוי כי העותר ישקול את הדבר על מנת שניתן יהא לקדם את המשך הטיפול הרפואי במהירות.

כאמור, לעת הזו, לא מצאנו עילה להיעתר לעתירה והיא נדחית ללא צו להוצאות.
