השופט ח' מלצר:

1.העותר 1 שלפנינו הוא גם העותר ב-בג"ץ 6319/07 עו" ד בן חורין נ' כנסת ישראל, התלויה ועומדת, יחד עם עתירות נוספות, בפני הרכב מורחב של בית משפט זה, ועניינה בתקיפת הוראות שונות ב חוק דחיית שירות לתלמידי ישיבות שתורתם אומנותם, התשס"ב-2002. בעתירתו זו שבפנינו מלין העותר על כך שהממשלה החלה בעת האחרונה, לדבריו, ביישום רפורמה בנושא תלמידי הישיבות החרדים הנמצאים תחת הסדר "תורתו אומנותו" ("רפורמת גבאי"). התנהלות זו עומדת, לטענתו, בניגוד ל"אמירה ברורה של בית המשפט העליון... שלא לקדם את הרפורמה" – עד שיתקבל פסק דין בבג"ץ 6319/07 הנ"ל.

2.דין העתירה להידחות על הסף, אף ללא קבלת תגובת המשיבים.

מבלי להביע עמדה כלשהי ביחס לטענותיו של העותר לעיצומן, או באשר לשיהוי הנטען כלפיו על ידי המדינה בהתכתבות שנוהלה עמו, הרי שבהיותו צד לבג"ץ 6319/07 הנ"ל – יכול העותר לפנות בבקשה מתאימה במסגרת ההליך העיקרי ולהעלות את השגותיו, ככל שיש לו עילה.

הנה כי כן, בנסיבות אלה, עומד לעותר סעד חלופי ודי בנתון זה כדי לדחות את עתירתו זו על הסף, וכך אנו מורים.

1.בנסיבות העניין – אין אנו עושים צו להוצאות.
