עניינה של עתירה זו קשור בהחלטת הדרג המדיני להסיר מחסומים וחסמים ברחבי יהודה ושומרון. טענת העותרים היא כי החלטה זו מנוגדת להמלצות הדרג הצבאי בראשות הרמטכ"ל, ולא נעשתה בתיאום עם המועצה לבטחון לאומי.

העתירה תוקפת את החלטת הדרג המדיני הן לגופה והן לענין הליך קבלתה.

אשר לתוכנה של ההחלטה, מ דובר בענין מדיני-בטחוני מובהק הנמנה על סוג העניינים אשר בית המשפט הגבוה לצדק אינו נוהג להתערב בהם, ולא הועלה בעתירה זו כל טעם המצדיק חריגה מעקרון טבוע זה.

אשר להליך קבלת ההחלטה, העותרים לא העמידו כל בסיס עובדתי ומשפטי לטענתם כי נפל פגם כלשהו בדרך קבלת ההחלטה, בין היתר, מבחינת התיאום והמעורבות הנדרשים מצד כל הגורמים הרלבנטיים לענין.

על יסוד כל אלה, דין העתירה להידחות.
