השופט א' רובינשטיין:

א. עניינה של העתירה בבקשת העותרים לרשום במזכירות בית המשפט את בקשתם לקיום דיון נוסף, ולעכב התייצבותם לריצוי מאסרם עד להכרעה בבקשתם לחנינה בפני נשיא המדינה.

ב. העותרים הורשעו בבית משפט השלום בירושלים (הנשיא כהן) בפ 4947/04 ביום 10.7.06 בעבירה של תקיפה בנסיבות מחמירות, לפי סעיפים 379 ו-382(א) לחוק העונשין, התשל"ז-1977 (להלן חוק העונשין); בעבירה של פציעה בנסיבות מחמירות, לפי סעיפים 334 ו- 335(א)(1) ו-(2) לחוק העונשין; ובעבירה של מעשי פזיזות ורשלנות לפי סעיף 338(5) לחוק העונשין. כנגד המבקש 2 הוגש אישום נוסף בגין עבירות בנשק, לפי סעיף 144(א) לחוק העונשין. בתמצית, בכתב האישום בו הורשעו העותרים נטען, כי המבקשים, יחד עם אחר, בעודם נושאים כלי נשק ועמם כלב, תקפו רועה צאן, תושב תקוע ותושבים נוספים, באגרופים, תוך שהם יורים באויר ובאדמה. על המבקש 1 נגזרו שבעה חודשי מאסר בניכוי ימי המעצר, שישה חודשי מאסר על תנאי ופיצוי בסך 1,000 ₪ לכל אחד מארבעת המתלוננים. על המבקש 2 נגזרו שמונה חודשי מאסר בניכוי ימי המעצר, שישה חודשי מאסר על תנאי לעניין עבירה מסוג תקיפה, ושלושה חודשי מאסר על תנאי לעניין עבירה של התפרעות או הפרעה לשוטר או עבירות נשק, ופיצוי בסך 1,000 ₪, אף כאן לארבעה מתלוננים.

ג. ערעור העותרים לבית המשפט המחוזי בירושלים (הנשיאה ארד והשופטים עדיאל ו מזרחי) נדחה (ע"פ 40076/07). בקשת רשות ערעור (רע"פ 6748/07) שהגישו העותרים לבית משפט זה נדחתה גם היא, מפי השופט ג'ובראן, ביום 10.3.08. נקבע כי ביום 10.4.08 יתייצבו העותרים לתחילת ריצוי עונשם.

ד. העותרים הגישו בקשה לדחיית מועד התייצבותם לריצוי העונש, נוכח בקשת חנינה שהוגשה על ידם לנשיא המדינה. בקשתם נדחתה (השופט ג'ובראן) ביום 4.5.08, שכן לא נמצא מקום לחרוג בעניינם מהכלל שאין בקשת חנינה מצדיקה את עיכוב ביצוע העונש או את דחיית מועד תחילת ריצויו. נקבע כי עליהם להתייצב לריצוי עונשם ביום 5.5.08.

ה. העותרים הגישו בקשה נוספת לעיכוב ביצוע העונש. ביום 5.5.08 קבע השופט ג'ובראן כי "לאור העובדה כי חג העצמאות מתקרב ובא ולבקשת המבקשים, אני דוחה את ביצוע עונש המאסר אשר הוטל עליהם ליום 20.5.08".

ו. בקשה שהגישו העותרים לקיום דיון נוסף בהחלטת השופט ג'ובראן לא נתקבלה לרישום במזכירות בית המשפט העליון, מהטעם שמ דובר בבקשה לדיון נוסף על החלטת שופט יחיד. ביום 15.5.08 קבע הרשם השופט מרזל כי משלא ניתן להגיש בקשה לדיון נוסף, ממילא אין מקום להזקק לבקשת העותרים לעיכוב ביצוע. העותרים פנו, כמצוין בעתירה, לנשיא המדינה בבקשת חנינה, ועמה בבקשה לעיכוב זמני של ביצוע מאסרם עד להחלטה באשר לחנינה.

ז. בעתירה הנוכחית נטען, כי קביעת בית המשפט שככלל אין בקשה לחנינה מצדיקה עיכוב עונש מאסר אינה חוקית, סותרת חוק יסוד ומאיינת את סמכות הנשיא לחנינה. עוד נטען כי "המשיבה מנועה מלכפות את מאסרם של העותרים עד למתן החלטה ע"י הנשיא". הוסף כי על פי חוק בתי המשפט ניתן לבקש דיון נוסף בשל הכרעה של מותב שלושה, מקל וחומר ניתן לבקש דיון נוסף כאשר ההחלטה ניתנה על ידי שופט אחד.

ח. (1) אין בידינו להיעתר לעתירה, באין עילה משפטית שמכוחה נוכל ליתן את הסעד המבוקש. אין המ דובר בנושא בו יש מקום לעשות שימוש בסעיף 15(ג) לחוק יסוד השפיטה; התיק נדון כסדרו בהליך הפלילי. במדרג הפלילי בא עניינם של המבקשים בפני בתי המשפט הקודמים, וכן מספר פעמים בפני בית משפט זה: בקשת רשות ערעור שהוגשה נדחתה, וכן בקשה לעיכוב ביצוע העונש, ובסופו של יום ניתנה ארכה נוכח חג העצמאות. בית משפט זה, בשבתו כבית משפט גבוה לצדק, אינו משמש כערכאת ערעור על החלטות אחרות של בית משפט זה.

(2) לגופם של דברים יצוין, כי הוראות סעיף 18 לחוק יסוד: השפיטה וסעיף 30 לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984, שעניינן סמכות בית המשפט לקיים דיון נוסף, קובעות במפורש כי התנאי לקיום דיון נוסף בפסק דין שניתן בבית משפט זה הוא כשמ דובר ב"עניין שפסק בו בית המשפט העליון בשלושה". תנאי זה אינו מתקיים בנדון דידן, בו הוגשה העתירה לדיון נוסף ביחס להחלטה שניתנה על ידי שופט יחיד של בית המשפט העליון (דנ"פ 3282/07 עדן בסון נ' מדינת ישראל (לא פורסם), הנשיאה ביניש; דנג"צ 10030/06 התנועה לאיכות השלטון נ' ראש הממשלה (לא פורסם), הנשיאה ביניש). ומכל מקום ובלא קביעת מסמרות אוסיף, כי ככלל אין החלטות בדן יחיד נחשבות הלכה מן הסוג אשר לשכמותו נועד הדיון הנוסף.

ט. אשר לבקשת העותרים לחנינה בפני נשיא המדינה, ציין כבר השופט ג'ובראן בהחלטה במסגרת הבקשה לרשות ערעור פלילי, כי אין בקשת חנינה מצדיקה עיכוב ביצוע או דחיה במועד ריצוי העונש (ע"פ 1806/01 לוי נ' מדינת ישראל (לא פורסם); ע"פ 3729/02 שימששוילי נ' מדינת ישראל (לא פורסם), השופט- כתארו אז- ריבלין); זאת - למעט במקרים חריגים ביותר. במקרה הנדון מוצו ההליכים המשפטיים בערכאות השונות; החנינה היא הליך שמחוץ למערכת הרגילה, וככלל אין מקום לכרוך בבקשת חנינה דחיית ביצוע.

י. על כן לא נוכל – כאמור – להיעתר לעתירה.
