1.סעיף 16(ב) לפקודת התעבורה [נוסח חדש] (להלן: הפקודה), אוסר על מורה לנהיגה להשתמש, בשעת הוראת נהיגה, בטלפון קבוע או נייד, אלא באמצעות דיבורית:

16. [...] (ב) מי שבידו רישיון להוראת נהיגה לא ישתמש, בשעת הוראת נהיגה, בטלפון קבוע או נייד, אלא באמצעות דיבורית; בסעיף זה –

"דיבורית" – התקן המאפשר שימוש בטלפון בלא אחיזה בו, ובלבד שאם ההתקן מצוי בטלפון, הטלפון יונח ברכב באופן יציב המונע את נפילתו;

"טלפון" – מכשיר המיועד לתקשורת שיש בו לחצנים לחיוג.

העותר, מורה לנהיגה במקצועו, מבקש כי נורה לשר התחבורה להכריז מתוקף סמכותו לפי סעיף 30(א) לפקודה, כי העבירה מושא העתירה תהא עבירת קנס. לטענתו, כאשר מורה לנהיגה נתפס משתמש במכשיר טלפון בשעת הוראת נהיגה, הוא נשפט ב בית המשפט לתעבורה, ולרוב מושת עליו עונש שלילת רישיון בפועל או על תנאי, מה שפוגע בפרנסתו או מסכן אותה. עבודתו של מורה נהיגה מחייבת לעתים שימוש בטלפון נייד, לשם התייעצות בין המורים, להחלפת מורים ברכב וכיו"ב, ובמידה שהדיבורית ברכב מתקלקלת לא נותרת הברירה בידי המורה אלא לעבור על החוק. לטענת העותר, אין מדובר בעבירה חמורה במיוחד, אלא בעבירה שדרגת חומרתה תואמת לעבירות ברירת קנס כמו עבירת שימוש בטלפון בנהיגה על ידי מי שאינו מורה לנהיגה לפי תקנה 28(ב) לתקנות התעבורה, התשכ"א-1961 וסעיף 2 לתוספת לצו התעבורה (עבירות קנס), התשס"ב-2002. לטענת העותר, יש בעבירה במתכונתה הנוכחית כדי להוסיף עומס מיותר על מערכת המשפט העמוסה ממילא.

3.דין העתירה להידחות על הסף, הן מהטעם שהעותר יכול היה לתקוף את התקנה בתקיפה עקיפה והן בשל אי מיצוי הליכים.

למרות שהדבר לא צוין בעתירה, מתברר כי העותר הורשע זה לא מכבר בעבירה מושא הערעור שלפנינו (פסק דינו של בית משפט השלום לתעבורה בבאר שבע (כב' השופט א' אופיר) בתת"ע 10183-08-11 מדינת ישראל נ' בזק (לא פורסם, 16.4.2012), בו הושת על העותר קנס בסך 1,000 ₪ ו-4 חודשי פסילה על תנאי למשך 3 שנים; ערעור שנדון ב בית המשפט המחוזי בבאר שבע (כב' השופטת ט' חיימוביץ') בעפ"ת 20616-04-12 בזק נ' מדינת ישראל (לא פורסם, 21.5.2012), בו קוצר התנאי לשנתיים בלבד). מכאן, שיכול היה העותר לבצע "תקיפה עקיפה" במסגרת ההליך הפלילי, ומקום בו קיימת אפשרות שערכאה דיונית תדון בחוקיות וסבירות תקנה במסגרת "תקיפה עקיפה", יש בכך להקים לעותר סעד חלופי שיש בו להביא לדחיית עתירתו (ראו, לדוגמה, בג"ץ 6090/08 ברגר נ' שר המשפטים (לא פורסם, 11.8.2008); ע"פ 104/72 ראב נ' מדינת ישראל, פ"ד כו(2) 412 (1972)).

4.העותר לא ציין בעתירתו כי פנה לגורמים הרלוונטיים (ובראשם המשיב) בניסיון להסדיר את הסוגיה העולה בעתירה. כידוע, בית משפט זה אינו מושיט סעד לעותר אשר לא מיצה את האפשרויות העומדות בפניו טרם הגיש עתירתו, ובכלל זאת פנייה אל הרשות המוסמכת בבקשה כי תפעיל את סמכותה ומתן שהות ראויה לרשות לבחון את הבקשה ואת נסיבותיה (ראו בג"ץ 2827/97 2624/97 2830/97 ידיד רונאל נ' ממשלת ישראל, פ"ד נא(3) 71, פסקה 14 לפסק דינו של השופט זמיר (1997); בג"ץ 4499/07 וליטניצקי נ' משרד הפנים מינהל האוכלוסין, פסקה 7 לפסק דינה של השופטת פרוקצ'יה (לא פורסם, 17.9.2007); בג"צ 1802/12 יונה נ' משרד התחבורה, התשתיות הלאומיות והבטיחות בדרכים, פסקה 7 לפסק דינו של השופט הנדל (לא פורסם, 14.3.2012); בג"ץ 2206/12 המועצה האזורית באר טוביה נ' הועדה הארצית לתכנון ובניה של תשתיות (לא פורסם, 24.5.2012); אודות ההבחנה בין "עתירה מוקדמת" ל"אי מיצוי הליכים" ראו אצל אליעד שרגא ורועי שחר המשפט המינהלי - עילות הסף 177-176 (2008)).

5.ייכבד העותר ויפנה למשיב, ואם וככל שלא יבוא על סיפוקו, שמורה לו האפשרות לחזור ולעתור לבית משפט זה בהתקיים עילה המצדיקה זו.

6.אשר על כן דין העתירה להדחות ללא צורך בתגובה. אין צו להוצאות.
