1.העותר 1 חכר החל משנת 1987 שטח של 3,260 מ"ר באזור התעשייה מחסום ארז. העותרת 2 הינה חברה שפעלה באזור התעשייה מחסום ארז החל משנת 1996, עד שפונתה משם במסגרת תכנית ההתנתקות. המשיבה (להלן – המינהלה) הינה המינהלה שהוקמה על פי חוק יישום תכנית ההתנתקות, תשס"ה-2005 (להלן – חוק ההתנתקות), במטרה לסייע למתיישבי חבל עזה וצפון השומרון ועל מנת ליישם את תכנית ההתנתקות. חוק ההתנתקות קבע כי יקומו ועדות זכאות, שתפקידן, בין היתר, לקבוע את זכאותם של תובעים לפיצויים, בהתאם לחוק ההתנתקות, כמו גם את היקף הזכאות וגובה הפיצויים. כן הורה החוק על הקמת ועדה מיוחדת, שתפקידיה שונים, וביניהם, לדון בהגדלת הפיצויים או בהקטנתם.

בעתירה זו מבקשים העותרים להורות למינהלה לפרסם לאלתר את כל ההחלטות של ועדות הזכאות או הוועדה המיוחדת, או הסכמים שערכה המינהלה עם המפונים, ואשר טרם פורסמו.

2.לטענת העותרים, אף שחוק ההתנתקות קובע במפורש כי כל ההחלטות הללו יפורסמו, לא התפרסמו החלטות הנוגעות לעסקים מפונים, אלא מקצתן בלבד. העותרים מוסיפים, כי פניותיהם לגורמים שונים במינהלה, לקבל את החלטות הוועדות, לא זכו כלל למענה. העותרים טוענים כי הם זכאים לפיצויים שאותם אינם מקבלים. לטענתם, העדר הפרסום יש בו כדי לפגוע בזכות הטיעון המוקנית להם אל מול הוועדות, ומוסיפים, כי ההימנעות ממתן הפיצויים גורמת להם לנזקים שונים, בעיקר כשהדבר נמשך לאורך זמן.

3.עמדת המינהלה היא, כי דין העתירה להידחות. לטענתה, ככל שמ דובר בזכות הטיעון של העותרים, הרי שהמקום לברר את טענותיהם אינו ב בית משפט זה, כי אם במסגרת הליכי הערעור על החלטות הוועדות. המינהלה מוסיפה בעניין זה, כי זכות הטיעון של העותרים כלל לא נפגעה, משום שהועמד בפניהם כל החומר הרלוונטי לתביעותיהם, וזה אינו צריך לכלול את כל החלטות הוועדות באשר הן. המינהלה מוסיפה וטוענת, כי פעלה, ועדיין ממשיכה לפעול ולעשות מאמצים, על מנת לפרסם את החלטות הוועדות השונות, בציינה כי מרביתן כבר פורסמו. המינהלה מסבירה, כי הליך פרסום ההחלטות הינו מורכב ואורך זמן, באשר מ דובר בהכנה ובפרסום של עשרות אלפי עמודים של החלטות. ולבסוף, טוענת היא כי הליך פיצויים של העותרים עדיין תלוי ועומד בפני ועדת הזכאות.

4.בהחלטה שהוצאנו בתום הדיון שהתקיים לפנינו (ביום 20.11.06), הצענו לצדדים להידבר ביניהם במגמה לאפשר שקיפות מירבית, בהתאם להצהרת המינהלה. בהחלטה זו גם נתבקשו העותרים להודיענו בתוך שבועיים אם הם עומדים על עתירתם, ואם כן, מדוע לא יגישו עתירה מינהלית לפי חוק חופש המידע, תשנ"ח-1998. ההידברות בין הצדדים, כך עולה מהודעת העותרים, לא צלחה. העותרים טוענים, כי חרף הצהרותיה, המינהלה אינה מפרסמת את כל ההחלטות המהותיות בעניינם של עסקים, כי היא ממשיכה להסתיר הסכמים שנעשו עם מפונים, וכי בהחלטות שהיא מפרסמת חסרים נתונים רלוונטיים לעותרים. במצב דברים זה, מבקשים הם לדון בעתירה לגופה.

5.דין העתירה להידחות על הסף מחמת קיומו של סעד חלופי.

הסעד החלופי העומד לרשות העותרים הינו הגשת עתירה מינהלית לבית המשפט לעניינים מינהליים, לפי חוק חופש המידע (ראו פריט 2 לתוספת הראשונה לחוק בתי משפט לענינים מינהליים, תש"ס-2000). אף שסמכותו של בית משפט זה ממשיכה להתקיים לצד זו של בית המשפט לעניינים מינהליים, הרי שככלל, בג"ץ לא ידון בעתירה מקום בו יש לעותרים סעד חלופי (ראו, למשל, בג"ץ 6219/06 ארגון בתי חולים פרטיים לחולים כרוניים בישראל נ' משרד האוצר, ניתן ביום 18.9.06, פסקה 7; בג"ץ 5710/06 פרידמן נ' ראש עיריית יהוד, ניתן ביום 21.8.06; בג"ץ 8589/05 דבאג' נ' שר הפנים, ניתן ביום 15.10.06). בהודעה מטעם העותרים טוענים הם כי "במצב דברים בו, עמדת המשיבה, מן השפה ולחוץ, הינה פרסום ושקיפות מלאה בהתאם להוראות בג"ץ, לכאורה אין כל טעם בהגשת עתירה מנהלית לפי חוק חופש המידע" (סעיף ז' להודעתם). לא מצאנו בטענתם נימוק של ממש מדוע זה אין טעם בהגשת עתירה מינהלית, שהיא כיום דרך המלך בעניין זה.

6.העתירה נדחית. בנסיבות העניין אין צו להוצאות.
