השופטת א' פרוקצ'יה:

1.עתירה כנגד החלטת בית הדין הארצי לעבודה (כב' הנשיא סטיב אדלר), אשר דחתה בקשת רשות הערעור של העותר על החלטת ביניים של בית הדין האזורי לעבודה בבאר-שבע, שעניינה סירוב לבקשת העותר לגילוי מסמכים בהליך.

2.העותר נתבע על ידי המשיבה 3 (להלן: המשיבה) בבית הדין האזורי לעבודה בבאר-שבע. מכתב העתירה עולה כי בתובענה מיוחסות לו עוולות הנוגעות לביצוע מעשים מיניים במשיבה, בהם מעשים חמורים, במסגרת יחסי עבודה. בפתח ההליך, הגיש העותר בקשה לקיום דיון מקדמי שעיקרו גילוי מסמכים. העותר ביקש לקבל לידיו חומר חקירה מתיק פלילי המתנהל נגדו, וכן מסמכים משני תיקי ערר המצויים בטיפולה של הפרקליטות, אשר כולם נוגעים, לטענתו, למסכת העובדתית נשואת התובענה. כמו כן, ביקש העותר לקבל לידיו מסמכים הקשורים לתובענה מקבילה שהגישה המשיבה כנגד מקום עבודתה, בבית הדין האזורי לעבודה בבאר-שבע, בגין אותה מסכת עובדתית.

3.ביום ה-8.10.07 החליט בית הדין האזורי לעבודה לדחות את בקשת העותר לקבל לידיו את המסמכים האמורים. העותר הגיש בקשה לעיון מחדש בהחלטה זו. בית הדין נעתר לה, ובחן בשנית סוגיות הנוגעות לגילוי המסמכים בהליך. בהחלטה מיום ה-22.11.07, ביקש בית הדין את עמדת פרקליטות מחוז דרום בנוגע לגילוי חומר חקירה בהליכים הפליליים, וזו התנגדה להעברת החומר.

לבסוף, ביום 27.11.07, החליט בית הדין, לדחות את כל בקשותיו של העותר. אשר לחומר החקירה בתיק הפלילי, קבע בית הדין כי מ דובר בחומר שאינו בחזקתה של המשיבה ולעותר אין זכות לעיין בו כל עוד לא הוגש נגדו כתב אישום. אשר לתיקי הערר, קבע בית הדין כי המסמכים הנוגעים אליו אינם קשורים לתובענה נשוא ההליך. אשר לבקשה לחשוף את התובענה שהגישה המשיבה כנגד המעביד, קבע בית הדין כי מ דובר בהליך נפרד, ובקשה בענין זה יש להפנות לערכאה המטפלת באותה תביעה.

4.על החלטה זו הגיש העותר בקשת רשות ערעור לבית הדין הארצי לעבודה (בר"ע 757/07). בית הדין הארצי דחה את הבקשה. הוא קבע בהחלטתו כי נושא גילוי מסמכים נתון לשיקול דעת הערכאה הדיונית, ורק במקרה של טעות קיצונית בשיקול הדעת השיפוטי תתערב ערכאת ערעור בהחלטה. במקרה זה, כך נפסק, כי לא נמצאה טעות משפטית או אחרת בהחלטת בית הדין האזורי, וכי מצויים בידי העותר אמצעים דיוניים המאפשרים לו להתגונן כנגד התביעה שהוגשה נגדו. בית הדין הוסיף, כי ככל שיחול שינוי בנסיבות מבחינת העררים התלויים ועומדים בפרקליטות, רשאי יהיה העותר לחזור ולהגיש בקשה מתאימה לבית הדין האזורי.

5.משהחליט בית הדין הארצי לעבודה לדחות את בקשת רשות הערעור של העותר, הוגשה עתירה זו. בעתירה, חוזר העותר על הטענות שהעלה בפני ערכאות בית הדין לעבודה, שעיקרן נחיצותו של הגילוי לניהול ההליך המשפטי, והסכנה כי ייגרם לו עיוות דין אם המסמכים לא יוגשו לעיונו. כסעד חלופי, הוא מבקש כי הדיון בתובענה יידחה עד להשלמת יתר ההליכים הקשורים בעניינו.

6.דין העתירה להידחות על הסף. מושכלות יסוד הם כי בית משפט זה אינו יושב כערכאת ערעור על החלטת בית הדין הארצי לעבודה, והוא נוהג ריסון רב בהתערבות בהחלטותיו. רק טעות משפטית מהותית, המשולבת בטעמים כבדי משקל של צדק שיפוטי, עשויה להצדיק התערבות (בג"ץ 525/84 נביל חטיב ואח' נ' בית הדין הארצי לעבודה, פ"ד מ(1), 673, 692-696 (1986). מרחב ההתערבות השיפוטי של בית משפט זה צר אף יותר מקום בו מתבקשת התערבות שיפוטית בהחלטות ביניים של בית הדין, הנתונות, בעיקרן, לשיקול דעת הערכאה הדיונית (בג"ץ 7544/00 קעטבי נ' נשיא בית הדין האזור (לא פורסם); בג"ץ 176/01 אבו הרביד נ' בית הדין הארצי לעבודה (לא פורסם); בג"ץ 674/07 נילי וינברג נ' נשיא בית הדין הארצי לעבודה, תק-על 2007(1), 893; בג"צ 248/08 I.T.N אינטגריקו (ישראל) נ' בית הדין הארצי לעבודה (לא פורסם), מיום 17.3.08).

7.בענייננו, מ דובר בהחלטות דיוניות הנתונות לסמכותה ולשיקול דעתה של הערכאה הדיונית (ראו תקנה 46(א) לתקנות בית הדין לעבודה (סדרי דין), התשנ"ב-1992 לענין סמכות הערכאה הדיונית ליתן צו לעיון במסמכים). בתחום זה, אף ערכאת ערעור אינה נוהגת להתערב, ותעשה זאת רק שעה שניכר בהחלטה שניתנה כי היא סוטה סטייה מהותית מדרישות הדין והצדק באותו ענין. לא כל שכן, התערבות בג"צ בהחלטות דיוניות מעין אלה היא צרה ביותר, ושמורה למקרים בהם ניכר כי ההחלטה הדיונית לוקה בטעות מהותית והסבה פגיעה קשה, עד כדי עיוות דין, לעותר.

8.בענייננו, לא נפלה כל טעות בהחלטת בית הדין האזורי לעבודה, ולא כל שכן שלא נפלה טעות מהותית שיש בה כדי לפגוע בו פגיעה שלא כדין. מרבית בקשותיו של העותר לגילוי החומר מתייחסות להליכים החורגים מתחומי התובענה שמתנהלת נגדו, ועל כן בצדק החליט בית דין האזורי כי אין מקום לקבלן. הוא הדין באשר לדרישת העיון בחומר החקירה המצוי בתיק הפלילי, שאינו מותר בעיון קודם להגשת אישום פלילי, ולמסמכי תיקי הערר התלויים ועומדים בפרקליטות. מסמכים שנתבקשו הנוגעים לתובענה אחרת המתנהלת בפני ערכאה אחרת אינם בגדר עניינו של בית הדין בהליך זה להורות על גילויים לעותר.

לאור כל אלה, אין עילה להתערב בהחלטת בית הדין האזורי לעבודה, ובהחלטת בית הדין הארצי אשר אימץ את קביעותיה.

העתירה נדחית על הסף.
