1.העותרת עתרה להורות למשיבים לפעול להפסקת שידור מחאת העובדים נגד סגירת רשות השידור ולנקוט כנגד המעורבים צעדים, לרבות הליכים משמעתיים ומשפטיים כנגד כל עובד רשות השידור המעורב בקמפיין המחאה. עוד ביקשה העותרת להורות למשיב 5 לנקוט בהליכים פליליים נגד כל המעורבים בשידור הקמפיין, ולהורות למשיבים 1 ו-5 לתבוע מכל המעורבים בשידור הקמפיין להשיב לקופת המדינה או לקופת רשות השידור את שווי ההטבה שנטלו לעצמם בשידור הקמפיין ולפצות את הציבור בגין הנזק שנגרם לו עקב כך.

במסגרת העתירה שהוגשה ביום 8.7.2014 נתבקש סעד ביניים, המורה למשיבים 3-1 להפסיק באופן מיידי את שידורי הקמפיין בזמן משחקי גביע העולם בכדורגל. הבקשה נדחתה על ידי בהחלטתי מאותו היום מאחר שהפנייה הראשונה של העותרת למשיבים נעשתה אך 24 שעות לפני הגשת העתירה.

2.טעם זה בגינו דחיתי את הבקשה לסעד ביניים כוחו יפה לדחייה על הסף של העתירה לגופה.

העותרת, בתשובתה לתגובה המקדמית של המשיבים, טענה כי פנתה במכתבה מיום 7.7.2014 למנכ"ל רשות השידור בצירוף העתק לגורמים שונים. באותו יום כבר נתקבלה תשובה של יו"ר רשות השידור, בה נאמר כי הוא פועל בכל הכלים העומדים לרשותו על מנת שהרשות תפעל על פי דין בהתאם לחוות דעתה של היועצת המשפטית של רשות השידור, וכי יום קודם לכן כבר פנה למנכ"ל רשות השידור והורה לו לפעול להפסקת השידורים האמורים. לטענת העותרת, משהתברר כי הוראת יו"ר רשות השידור זוכה להתעלמות מופגנת, התחוורה לה אוזלת היד של המשיבים, ומשכך, ההליכים מוצו טרם הגשת העתירה.

3.ולא היא. העותרת פנתה במכתב מיום 7.7.2014 אל מנכ"ל רשות השידור, בצירוף העתקים למשיבים, וכבר למחרת עתרה לבית משפט זה, מבלי להמתין כלל לתשובת המשיבים 4-5 ולאחר שנענתה על ידי המשיב 2 שתמך בעמדתה. על הטעם בצורך במיצוי הליכים עמד בית משפט זה בבג"ץ 4934/08 מלכית נ' ראש ממשלת ישראל (25.6.2008):

טעמו של הכלל אינו טכני או פורמאלי. הרעיון הניצב בבסיסו הוא כי הידברות ישירה עם הרשות המוסמכת, עשויה לפתור את המחלוקת בין הצדדים ולייתר את הצורך בהתדיינות בין כתלי בית המשפט. לעיתים תשתכנע הרשות בצדקתו של הפונה אליה. לעיתים ישתכנע הוא בצדקת הרשות. עתירה לערכאות לעולם תהא מוצא אחרון. יתרה מכך, הפנייה לרשות – והתשובה המנומקת המתקבלת בעקבות כך – מאפשרת בהמשך לבית-המשפט לבחון את שיקול הדעת המנהלי שהופעל, ולקיים ביקורת שיפוטית. אף אין זה ראוי כי בית-המשפט יפעל לפני שניתנה לרשות הזדמנות להפעיל סמכותה ולגבש עמדתה בנושא השנוי במחלוקת.

מטעמים אלה, אין די בהצהרת העותרים כי עמדתו של היועץ המשפטי לממשלה ידועה לכל. אף לא ניתן להסתמך על טענתם כי גורמים אחרים פנו למשיב באותו עניין, שכן אין לדעת מהן הטענות המדויקות שאותם גורמים העלו בפניו, אם בכלל, ומהן התשובות והנימוקים שניתנו להם בתגובה.

קל וחומר במקרה דנן, שעמדת היועץ המשפטי לממשלה, המשיב 5, לא הייתה ידועה לעותרים, ובהמשך נתברר, מתשובות כל המשיבים, שהם מצדדים למעשה בעמדתה של העותרת. כך, המשיבים 5-4 הבהירו כי הם שותפים למסקנה אליה הגיעה היועצת המשפטית של רשות השידור, ולפיה ניצול משאבי ציבור לצרכים אישיים על ידי מי שיש לו גישה אליהם מתוקף תפקידו הציבורי, ובענייננו עובדי רשות השידור, היא פעולה שנעשית בחוסר סמכות ובניגוד לדין. המשיבים 5-4 תמכו אפוא בעתירה והודיעו כי הם סבורים כי על הנהלת רשות השידור לפעול לאלתר להפסקת ההתנהלות האמורה. ואילו המשיבים 3-1 הודיעו כי שלחו מכתבים למנהלים בטלוויזיה ולמנהל "קול ישראל", בהם דרשו לפעול בהתאם לחוות הד עת המשפט ית ולמנוע בכל דרך אפשרית את השידורים האסורים. המשיב 3 הודיע כי הורה למנהלים לנקוט בכל הצעדים להפסקת התופעה, לרבות צעדים משמעתיים כלפי המעורבים.

4.דין העתירה להדחות אפוא על הסף, מאחר שהעותרת חטאה באי מיצוי הליכים בכך שהגישה את עתירתה יום אחד בלבד לאחר ששלחה את מכתבה למשיבים, ומבלי שניתנה להם שהות מינימלית להגיב לטענות המועלות במכתב (למעט, כאמור, המשיב 2 שהשיב כבר באותו יום ותמך בעמדת העותרת). אין לי אלא לחזור ולהפנות להחלטתי בבקשת הביניים, שם הפניתי לדברי השופט (כתוארו דאז) מ' חשין:

אצה לו הדרך לעותר. המכתב אל רשויות המדינה נכתב ביום 29.6.04, ולא חלף אלא שבוע ימים, וביום 6.7.04 הוגשה העתירה המונחת לפנינו והיא עתירה המעלה את טענות העותרת במלואן. לא זו הדרך לפנות לבית המשפט הגבוה לצדק" (בג"ץ 6394/04 ארגון האמבולנסים הפרטיים בישראל נ' מגן דוד אדום (10.2.2005)).

3.למעלה מן הצורך אציין כי מתשובות המשיבים עולה כי העובדים חדלו מהצגת תשדירי המחאה ביום 22.7.2014, וכי המשנה ליועץ המשפטי לממשלה, עו"ד ליכט, פנה באותו יום לרשות השידור והתריע כי אם יחודשו השידורים ולא ינקטו צעדים אופרטיביים להפסקת שידורים אלו, ינקוט היועץ המשפטי לממשלה בצעדים כלפי מנכ"ל רשות השידור ואחרים, לרבות על פי דין משמעתי.

בנוסף, חלו התפתחויות חקיקתיות במסגרתן נחקק חוק השידור הציבורי התשע"ד-2014, אשר מסדיר הקמת תאגיד שידור ציבורי חדש וכן מסדיר את ההליכים לפירוק רשות השידור, ביטול אישיותה המשפטית וביטול חוק רשות השידור (פרק ט"ז סימן א' לחוק). לאור זאת, יהא זה מפרק הרשות שיצטרך לשקול אם יש מקום בנסיבות שנוצרו להורות על תביעת השבה כנגד המעורבים בקמפיין.

ולבסוף, דומה כי ראוי היה לצרף לעתירה את הגורמים הרלבנטים העשויים להיפגע מקבלת העתירה, כמו נציגות עובדי רשות השידור.

4.סופו של דבר כי דין העתירה להידחות על הסף מחמת אי מיצוי הליכים, מה עוד שחלק מהסעדים שנתבקשו התייתרו.

בנסיבות העניין אין צו להוצאות.
