בהסכמת בא-כוח העותרים עיינו בחומר המשטרתי החסוי מטעמים מודיעיניים ואכן מתברר כי על פי תשתית מודיעינית יש חשדות ממשיים נגד העותר. בנסיבות אלה נשלל מהעותר מעמד של תושב ארעי בעל רישיון ישיבה מסוג א/5 ועקב הפסקת הליך איחוד המשפחות ובהיעדר מעמד היה על העותר לעזוב את ישראל. לעניין זה הוצא צו הביניים בעתירה. העותר היה בעל רישיון מסוג א/5 מאז שנת 2000 והוא מנהל בישראל עסקים ענפים. לאחר חילופי דברים הסכימה באת-כוח המשיבים להעניק לעותר היתר מת"ק, היתר שהייה מתחדש למשך שנה, והציעה כי בתקופת השנה יבחנו המשיבים פעם נוספת את עניינו של העותר ויהיה עליהם לגבש עמדה ביחס לחשדות הפליליים שהמשטרה מייחסת לעותר. בנסיבות העניין ונוכח התוצאה המחמירה של שלילת רישיון הישיבה מסוג א/5, בנסיבותיו של העותר כיום, אנו מורים כי יוארך רישיון הישיבה כפי שהיה בתוקפו למשך 6 חודשים מהיום, כרישיון זמני מסוג א/5. בתום ששת החודשים ישקלו המשיבים מחדש את הארכת הרישיון על פי הנתונים שיהיו בידם ביחס להתנהגותו של העותר והחשדות המשמעותיים שיש נגדו.

בכפיפות לאמור העתירה נדחית.
