פסק-דין

1.העתירה שבפנינו מופנית נגד החלטה לפנות את מאחז תקוע ה'. המאחז אמור להיות מפונה היום. העתירה הוגשה הבוקר וזמן קצר לאחר הגשתה ניתן צו ארעי שאסר את הריסת המבנים היבילים שבמאחז.

2.בעלי הדין קיבלו את הצעתנו שאלה פרטיה:

א. העותרים מתחייבים כי המאחז יפונה, כולל המבנים היבילים במקום, תוך 14 ימים מהיום (תקופת הפגרה תימנה במניין הימים), וכן הם מצהירים שלא יגישו עתירה נוספת בעניין.

ב. ניתן בזה צו לפנות את המאחז, כולל המבנים היבילים. הצו יבוצע אם העותרים לא יקיימו את התחייבותם.

ג. המועד של 30 ימים, הנקוב בתקנה 2ב לתקנות בדבר העברת טובין (הובלת מבנים יבילים) (יהודה ושומרון), התשנ"ג-1993, מוקפא החל מהיום. על כן, לא תהא מניעה לבצע את הפינוי ותפיסת המבנים היבילים אף בחלוף שלושים ימים ובהתחשב בהקפאה, וזאת בתוספת שבעה ימים.

3.ניתן תוקף של פסק-דין להסדר. לא ייעשה צו להוצאות.

ניתן היום, ד' באב התשע"ד (31.7.2014), בנוכחות באי כוח בעלי הדין.
