1.עניינה של העתירה שלפנינו בסכסוך אישי ומשפחתי שנתגלע במשפחתם של העותרים. הנפשות הפועלות הן העותר 3 (להלן: כמיל) שהוא גרושהּ של גב' חנאן והבה (להלן: חנאן), העותר 2, הוא בנם המשותף של כמיל וחנאן, והעותר 3 הוא אחיו של כמיל.

לטענת העותרים מתקיים קשר בין חנאן לבין המשיב 6 (להלן: המשיב) המשרת כסגן מפקד תחנת המשטרה בכרמיאל. על רקע זה פרצה "מלחמת עולם" זוטא בה מעורב בנם המשותף של חנאן וכמיל, בשם האא'ל והבה (להלן: האא'ל), אשר אך לאחרונה שירת כשוטר שח"ם בתחנת כרמיאל. במסגרת הסכסוך הוגשו תלונות הדדיות של הצדדים ונפתחו תיקי חקירה בגין אלימות במשפחה, תקיפות ואיומים. חלק מהתלונות ההדדיות נסגרו מסיבות שונות (כמו חוסר אשמה) וחלקן עדיין בחקירה.

2.לטענת העותרים, תחנת כרמיאל תחת פיקודם של המשיב והמשיב מס' 5 מתנכלת להם ופועלת נגדם ממניעים ושיקולים זרים שבבסיסם הסכסוך המשפחתי. שיאם של האירועים, מבחינת העותרים, התרחש בחיפוש אמל" ח שנעשה בבית העותרים 2-1 על ידי שוטרים ממשטרת כרמיאל (להלן: חיפוש האמל"ח), ואשר לטענתם התבצע באמצעות צו חיפוש שהושג על ידי הצגת חומר מפוברק ל בית המשפט, במטרה להתעמר ולהתנכל לעותרים. העותרים טענו כי החיפוש בביתם נעשה בחריגה מסמכות ובניגוד לכללי הצדק הטבעי; כי החיפוש נעשה על בסיס מידע שקרי (להלן: המידע); כי שימוש במידע שקרי הינו שיבוש הליכי משפט; וכי יש חשיבות לחשיפת המידע בפני העותרים, שכן אחרת לא יוכלו להתגונן מפני ההאשמות המופנות כלפיהם. עוד נטען כי האירועים שתוארו בכתב העתירה מהווים הצדקה להעברת המשיב מתפקידו, שכן הוא נוהג לנצל מצוקת נשים הנמצאות בהליכי גירושין.

בעתירתם דורשים העותרים שורה של סעדים שעניינם העיקרי כי תיערך חקירה ויימסר להם המידע המודיעיני שהוביל את משטרת כרמיאל לערוך חיפוש בביתם של העותרים 2-1. כן עתרו ליתן צו ביניים במעמד צד אחד, המורה להשעות או להעביר מתפקידם את המשיב ואת המשיב 5, מפקד תחנת המשטרה בכרמיאל.

3.דין העתירה להידחות על הסף ולו בשל היותה כללית וכוללנית, נשענת על השערות וספקולציות וחסרת תשתית עובדתית של ממש.

4.בנוסף, דין העתירה להידחות בשל אי מיצוי הליכים וקיומו של סעד חלופי. כפי שעולה מהעתירה ומתגובת המשיב, תלונות הוגשו מצד העותרים למח"ש ולמפכ"ל המשטרה. חלק מהתלונות ההדדיות שהוגשו על ידי הצדדים עודן מתבררות במשטרה, במח"ש, וביחידה במשטרת ישראל לתלונות הציבור. בחלק מן המקרים, ועל מנת למנוע לזות שפתיים, הועברו תלונות בני המשפחה לבירור בתחנת משטרה אחרת, שאינה תחנת משטרת כרמיאל. ביני לביני, אף הפסיק האא'ל לשרת בתחנת המשטרה בכרמיאל.

על החלטות משטרה ומח"ש שלא לפתוח בחקירה או לסגור תלונה שהוגשה ניתן לערער לפי סעיף 64 לחוק סדר הדין הפלילי [נוסח משולב], התשמ"ב-1982, וככל שמדובר בתלונה שהוגשה למשטרה ניתן להגיש ערר כאמור בסעיף 17ב(1) לפקודת המטה הארצי 06.03.01 העוסקת בטיפול בתלונות הציבור. משלא עשו כן העותרים, אין מקום לקפנדריא בדרך של הגשת עתירה ל בית משפט זה.

5.באשר לחשיפת המידע על בסיסו ניתן צו החיפוש למשטרה, המשיבים הביעו נכונות להציג את המידע המודיעיני שעמד בבסיס הצו לעיני בית המשפט, אך איני רואה טעם בכך. ככל שסבורים העותרים כי החיפוש נעשה שלא כדין, פתוחה בפניהם הדרך לעתור ל בית המשפט שנתן את הצו, או להגיש תלונה למח"ש אודות התנהלותה הפסולה של תחנת כרמיאל, כטענתם. באשר לדרישת העותרים להעברת החקירה בעניין חיפוש האמל"ח מידי המשטרה לידי השב"כ, תמהני על מה היא מבוססת. החזקת נשק היא עבירה פלילית שבתחום טיפולה של המשטרה, וכפי שקובע סעיף 3 לפקודת המשטרה [נוסח חדש], התשל"א-1971, "משטרת ישראל תעסוק במניעת עבירות ובגילויין, בתפיסת עבריינים ובתביעתם לדין, בשמירתם הבטוחה של אסירים, ובקיום הסדר הציבורי ובטחון הנפש והרכוש".

6.אשר על כן, העתירה נדחית. לפנים משורת הדין, אין צו להוצאות.
