עניינה של העתירה שלפנינו בבקשת העותר, נָגד צה"ל בגמלאות, להעלות למפרע מיום פרישתו בשנת 1982 את דרגתו לדרגת רס"ב לצורך העלאת הקצבה המשולמת לו מאז פרישתו.
1.העותר יליד 1935, התגייס לחיל הים בשנת 1953, השתחרר בתום שירותו הסדיר, בחלוף שנתיים התגייס לשירות קבע, עלה בסולם הדרגות עד לדרגת רס"ר שהוענקה לו בשנת 1971, והמשיך לשרת בצבא קבע עד לפרישתו בשנת 1982 בדרגת רס"ר עם חמישה כוכבים. נציין כי בשנת 1981 שונתה שיטת דירוג הנגדים בצה"ל, כך שבעת פרישתו הועמדה דרגת השכר של העותר לפי סולם הדרגות החדש על דרגת רס"ר. לאחר פרישתו המשיך העותר לשרת במילואים בבסיס חיל הים בחיפה עד לשנת 1989 עת חזר לשירות בתור אזרח עובד צה"ל עד הגיעו לגיל 65.
2.בשנת 2008 פנה העותר לגורמים הרלוונטים בצה"ל בבקשה לבחון את האפשרות לעדכן ולהקביל את דרגתו לדרגות הנגדים הנוכחיות. לאור בקשת העותר נערכה פגישת עבודה בין הגורמים הרלוונטים, ובסיכום הפגישה מיום 24.11.08 נכתב כי הבקשה נדונה "על מנת לדון בהיבט ההומאני בלבד בעקבות פנייתו של רוני מור [העותר – י.ע.] ורצונו לקבל דרגה ואין הכוונה בהענקת דרגה לשנות זכויות או תגמולים". לבסוף הוחלט להיענות לבקשת העותר וביום 2.12.08 הוחלט להעלות את דרגתו לדרגת רס"ב במילואים רטרואקטיבית החל מיום 1.1.89, חודשיים לפני שסיים את שירות המילואים הפעיל ביחידה.
3.בראשית שנת 2010 פנה העותר באמצעות בא כוחו לרמטכ"ל בתביעה לעדכן את קצבתו למפרע לפי דרגתו הנוכחית. בין היתר צויין כי העותר קופח בשעתו מאחר שמפקדו הישיר לא המליץ על עדכון דרגתו בשנת 1982 מטעמים של יריבות אישית. העותר נענה במכתב מאת מזכירות הפיקוד העליון (מיום 12.1.10), כי הקצבה המשולמת לגמלאי צה"ל מחושבת לפי הדרגה בעת הפרישה ועדכון הדרגה לאחר שנים אינו משפיע על גובה הקצבה. עוד נאמר במכתב כי לאור סיכומים בין משרד האוצר לצה"ל, העותר נהנה כיום מקצבה התואמת לדרגת רס"מ הגבוהה מהדרגה בה השתחרר. ב"כ העותר ביקש לערור בפני ועדת הערעור לגמלאות לפי סעיף 44 לחוק שירות הקבע בצה"ל (גמלאות) [נוסח משולב], התשמ"ה-1985 (להלן: החוק), אך הובהר לו במכתב נוסף מאת המשיב כי אינו רשאי לערור מאחר שעבר זמן רב מאז שהתקבלה בעניינו ההחלטה בעניין גובה הקצבה המגיעה לו בעקבות פרישתו מצה"ל (מכתב מאת מזכירת הפיקוד העליון מיום 14.3.11).
4.העותר טוען כי זכותו לפנות לערכאת הערעור נשללה ממנו שלא כדין, מאחר שמעולם לא הגיש תביעה לקבלת גמלה ולא התקבלה בעניינו החלטה מאת הממונה המאפשרת ערעור כאמור בחוק. עוד טוען העותר כי הוא היה זכאי לקבל את הדרגה הנוכחית עוד לפני פרישתו, ולראייה צירף לעתירה אותות הצטיינות והערכה לפועלו, וכי אי העלאת הקצבה למפרע פוגעת בזכותו הקניינית.
המשיב טוען כי הקצבה מחושבת על בסיס שכרו של הגמלאי עובר לפרישתו, וכי לדרגת המילואים שהוענקה לעותר רטרואקטיבית החל מסיום שירות המילואים שלו, אין כל נפקות כספית ומשמעותה היא אך במישור הפיקודי/היררכי.
5.דין העתירה להדחות על הסף ממספר טעמים.
ראשית, העתירה לוקה בשיהוי כבד, לאחר שעברו כשלושים שנה מפרישתו של העותר. גם אם ייאמר לזכותו של העותר שמרוץ השיהוי החל מיום תביעתו להעלאה בדרגה (בשנת 2008), הרי שרק כעבור למעלה משנה, בתחילת שנת 2010, פנה למשיב בבקשה להכיר בדרגה לצורך גמלה ואילו העתירה דנן הוגשה כעבור למעלה משלוש שנים מהיום בו הוחלט על העלאתו בדרגה.
שנית, העתירה מעלה מן האוב טענות בדבר התנכלות מצידו של מפקד העותר בשנות השמונים של המאה הקודמת. קשה לצפות מהמשיב לשחזר את מהלך העניינים ביחידה בה שירת העותר לפני למעלה משלושים שנה כדי לבסס כיום את דרגתו של העותר בשעת פרישתו מהצבא.
שלישית, ועיקרו של דבר, דין העתירה להידחות בגין אי מיצוי הליכים. סעיפים 49-43 לחוק מסדירים את הליך התביעה והערעור לקבלת קצבה מהצבא. סעיף 47(א) לחוק קובע כי התובע גמלה יגיש תביעה לממונה, סעיף 48 לחוק קובע כי מי שרואה עצמו נפגע מהחלטה של הממונה רשאי לערער עליה לפני ועדת ערעור תוך 60 יום, וסעיף 49 לחוק קובע כי "התובע או הממונה רשאי, תוך שלושים ימים מיום שהגיעה אליו החלטת ועדת הערעור, לערער עליה בשאלה משפטית ל בית המשפט המחוזי".
העותר הצהיר כי לא פנה כלל אל הממונה לתשלום גמלאות במשרד הבטחון. ייכבד אפוא העותר וייפנה לגורמים הרלוונטים על פי החוק בבקשה לדון בעניינו.
6.אשר על כן דין העתירה להידחות על הסף. לפנים משורת הדין, אין צו להוצאות.
