בקשה למחיקת העתירה

בעתירה זו התבקש בית המשפט להורות למשיבים לפעול באופן מיידי להתקנת התקנות הדרושות לביצוע חוק הנהיגה הספורטיבית, התשס"ו-2005, לרבות בעניין יבוא כלים תחרותיים וחלקי-חילוף. בעתירה, שהוגשה ביום 9.8.2010, נטען כי חרף העובדה שחלפו למעלה מארבע שנים ומחצה מאז שפורסם החוק, ולמעלה משלוש שנים מאז שנכנס לתוקף, טרם הותקנו כל התקנות הדרושות ליישומו של החוק, בהתאם לסמכותו של המשיב שהיא בגדר סמכות שבחובה.

לא אתאר כאן את כל השתלשלות העניינים מאז שהוגשה העתירה, אך אדגיש כי התקיימו שלושה דיונים לפני הרכב; הוגשו כמה וכמה הודעות עדכון מטעם המשיבים; ביום 12.1.2012 ניתן צו-על-תנאי; וביום 7.8.2012 הודיעה העותרת כי לאור פרסום חקיקת המשנה כפי שהתבקש בעתירה, היא מסכימה למחיקת ההליך ומבקשת לחייב את המשיבים בהוצאותיה הריאליות בסך של 122,343 ₪. המשיבים מסרו תגובה לעניין ההוצאות והעותרת הגישה תשובה לתגובה.

בשל תקלה הובא התיק לפניי רק לאחרונה.

כעולה מן האמור לעיל, העתירה מיצתה את עצמה והעותרת מסכימה למחיקתה. משכך, אני מורה על מחיקת העתירה.

אשר להוצאות: עיון במסמכים שבתיק מעלה כי מלכתחילה לא הייתה מחלוקת באשר לצורך בהשלמת הליך חקיקת המשנה, כאשר המשיבים פעלו בעניין זה לפני הגשת העתירה וכן לאחר הגשתה. אולם, בעוד שהעותרת טענה, וטוענת כיום, כי התהליך לא בוצע במהירות הראויה והנדרשת, הרי שהמשיבים הדגישו, ועודם מדגישים, את המאמצים הרבים שהושקעו בכל הנוגע להתקנת התקנות, את מורכבותו וייחודיותו של הנושא, ואת הסיבות האובייקטיביות להתמשכות התהליך (בכללן קיום התייעצויות ודיונים וכן שמיעת הערות מפי גורמים שונים ובהם נציגי העותרת). כמובן, אין מקום לקבוע מסמרות בגדרי הבקשה לפסיקת הוצאות, ויש לזכור כי ההליך הסתיים בטרם הכרעה סופית של הרכב. עם זאת, סבורני כי יש מקום לפסיקת הוצאות במקרה זה, בסכום מאוזן המבטא את כלל השיקולים.

אדגיש כי בנסיבות העניין, ובשים לב לתהליך חקיקת המשנה שהתקיים עוד לפני הגשת העתירה, אין לקבוע כי הגשת העתירה היא הגורם העיקרי להכרתם של המשיבים בחובתם להשלים את חקיקת המשנה. בהקשר זה יודגש כי המשיבים התקינו את רוב התקנות הדרושות ליישומו של החוק לפני הגשת העתירה או בסמוך לאחר מכן, וכי גם הטיפול בנושא של תקנות הייבוא החל לפני הגשת העתירה. בה-בעת, סבורני כי הנסיבות מצביעות שהעתירה הייתה מוצדקת מבחינתה של העותרת (גם אין טענה שהוגשה בשיהוי או ללא מיצוי הליכים), וראוי להניח כי היה בהגשת העתירה כדי לתרום לקידום העניין, ולוּ במישור הזמן (ודוק: זירוז הליכים היה התכלית העיקרית של העתירה). בהקשר זה יודגש כי בית המשפט קיים שלושה דיונים בתיק; כי החלטות בית המשפט שיקפו את הצורך בהתקדמות מהירה אל-עבר המטרה; וכי בית המשפט אף מצא לנכון ליתן צו-על-תנאי. עוד יוטעם כי עוד ביום 17.8.2011 הודיעו המשיבים כי התקנות נחתמו ויישלחו לפרסום, ועל כן – כך טענו אז המשיבים – העתירה התייתרה ודינה להימחק ללא צו להוצאות; אלא שבהמשך התברר כי חל עיכוב נוסף בפרסום התקנות, וכי נמצא (בסוף שנת 2011) שראוי להעביר את סמכות התקנתן משר התמ"ת לשרת התרבות והספורט. או-אז ניתן הצו-על-תנאי, ובסופו של דבר פורסמו התקנות כשנה לאחר אותה הודעה מיום 17.8.2011.

לאור האמור, באתי כאמור לכלל מסקנה כי ראוי לפסוק לעותרת הוצאות בסכום סביר, המשקף איזון ראוי בין השיקולים לכאן ולכאן. לאחר בחינת טענות הצדדים, הן לעניין פסיקת ההוצאות הן לעניין גובהן, מצאתי כי הסכום המתאים הוא 20,000 ₪ (סכום זה כולל הוצאות משפט ושכר-טרחת עורך-דין). הסכום האמור יישא הפרשי הצמדה וריבית כדין מיום ההחלטה ועד התשלום בפועל.
