עניינה של העתירה שבפנינו הוא בבקשת העותר, כי המשיב ינמק מדוע לא תוענק לו אזרחות ישראלית. כפי שעולה מן העתירה, העותר הינו תושב האזור, נשוי לאזרחית ישראל ומתגורר כיום עימה ועם חמשת ילדיהם בנצרת. המשיב מציין, כי העותר שוהה בישראל כיום מכוח היתרי מת"ק המוארכים מעת לעת. הבקשה להענקת אזרחות, באה על רקע הקשיים בהם נתקל העותר בטיפול בילדיו ובמשפחתו, בשל מעמדו.

יצוין, כי העתירה הנוכחית, הינה השלישית שהוגשה על ידי העותר בבקשה לקבל מעמד בישראל במסגרת ההליך המדורג (בג"צ 3981/06 פאח'ורי נ' שר הפנים (לא פורסם, 16.9.2007); בג"צ 4390/07 פאח'ורי נ' שר הפנים (לא פורסם, 18.12.2007), בהם הוגשה עתירה לקבלת מעמד של תושב ארעי (א/5). וראו גם בג"צ 2028/06 פאח'ורי נ' המינהל האזרחי, איו"ש (לא פורסם, 12.2.2007), שעסק בבקשה לקבלת רישיון נהיגה ישראלי). בעתירות הקודמות הובהר לעותר, כי על פי ההסדר בחוק האזרחות והכניסה לישראל (הוראת שעה), התשס"ג-2003 (להלן: חוק האזרחות), שר הפנים מוסמך אמנם להאריך תוקפו של רישיון ישיבה או היתר שהייה בישראל לתושב האזור, אך ברגיל לא תוענק לו אזרחות ואף לא יונפקו רישיונות ישיבה חדשים. בעקבות כך, ועל אף נסיבותיו המשפחתיות של העותר, נדחו שתי העתירות הקודמות על הסף. יתרה מכך, כבר בעתירה מיום 18.12.2007, הדגיש בית המשפט, כי בהיעדר שינוי מהותי בנסיבות, אין כל הצדקה להגשת עתירה חוזרת בעילה הזהה לעתירות הקודמות, ולפיכך דינה להידחות על הסף מטעם זה בלבד.

בתגובה לעתירה שהוגשה בפנינו, טען המשיב כי מלבד הנימוקים שצוינו לעיל, יש לדחות את העתירה גם בגין קיומו של סעד חלופי, בדמות הפניית הבקשה לבית המשפט לעניינים מנהליים. עוד צוין, כי ככל שבקשת העותר נוגעת לקבלת רישיון לישיבת ארעי או היתר שהייה בישראל, יש למצות את ההסדר הקבוע בחוק לטיפול בה, בטרם הגשת עתירה. סעיף 3א1 לחוק האזרחות קובע, כי פניות אלה יידונו בוועדה מקצועית, אשר תגיש לאחר מכן את המלצותיה למשיב, לצורך מתן רישיונות לזכאים לכך. בקשה מסוג זה הונחה לדברי המשיב על שולחנה של הוועדה בחודש אוגוסט 2008 והיא צפויה לדון בה באחת מישיבותיה הקרובות. משכך סובר המשיב, כי לפחות לעניין זה, העתירה הנוכחית הינה מוקדמת.

דין העתירה להידחות על הסף. הטיפול בבקשות למתן רישיונות לישיבת ארעי מטעמים הומניטריים מיוחדים, נמצא כאמור בסעיף 3א1 לחוק האזרחות, בסמכותו של המשיב, לאחר שקיבל את המלצותיה של הוועדה המקצועית. מסלול מקביל לקבלת רישיון לישיבה בישראל ואף אזרחות במקרים חריגים, מצוי בסעיף 3ג לחוק האזרחות. משלא הראה העותר, כי מיצה את ההליכים הקבועים בחוק להסדרת מעמדו, העתירה הינה מוקדמת ודי בכך כדי לדחותה אף מבלי להידרש ליתר הנימוקים שצוינו לעיל.

אשר על כן, העתירה נדחית על הסף.
