הנשיאה ד' ביניש:

העתירה שלפנינו מופנית כנגד הסירוב של המשיבים 1 ו-2 ליתן לעותרים פטור מתשלום ארנונה, או לחלופין להעניק להם הנחות בת שלומי הארנונה. העותרים מכוני מחקר הפועלים בירושלים ובהם ספריות ואולמות הרצאות שבהם פועלים חוקרים העוסקים בנושאי ירושלים והמזרח התיכון בנושאי היסטוריה, ארכיאולוגיה ונושאים אחרים הקשורים בהם, נהנו מפטורים עד לשנת 2004.

לאחר שניתנו בעבר פטורים שונים מארנונה שלא על בסיס שוויוני ובעקבות פסיקתו של בית משפט זה, נוסחו קריטריונים כדי שניתן יהיה להכריע בשאלת הפטור על בסיס שוויוני ומתוך הצורך לצמצם את מתן הפטור שמטיל את נטל הארנונה על תושבי העיר. ההכרעה בשאלת הפטור היא בסמכות שר הפנים, על פי המלצת העירייה והסמכות הואצלה לממונה על המחוז.

בקשות הפטור של שני המוסדות נידונו בפני העירייה, אם כי הוועדה המקצועית לא השלימה את הדיון בעניין מכון אולברייט בטרם נתקבלה החלטת הממונה על המחוז, וביחס לעותרת השנייה המליצה העירייה על מתן הפטור. בשני המקרים דחתה הממונה על המחוז את הבקשות בשל אי עמידה בקריטריונים 5 ו-6 של סעיף 5(י) לפקודת מסי העירייה ומסי הממשלה (פיטורין) 1938.

לא ראינו להתערב בהחלטה זו משום שהפרשנות שניתנה לקריטריונים האמורים מצמצמת את מתן הפטור, לא על פי השיקול אם המוסד או הגורם המבקש פטור, תורם לעיר ירושלים, אלא על פי אמות המידה שאותו מוסד משרת בעיקר את תושבי הרשות המקומית. שני המוסדות העותרים הם מוסדות חשובים שפעילותם אכן תורמת למעמדה של ירושלים, אך עיקר פעילותם זו אינה משרתת את תושבי ירושלים עצמם. בעת הדיון לפנינו עלתה האפשרות שהעותרים יבקשו פטור לפי סעיף 4(IV)(ג) החל על ספריות במוסדות חינוך, מסלול שהעותרים לא פעלו על פיו ולא היפנו אליו בבקשותיהם לפטור.

באות-כוח המשיבים לא ידעו בשלב זה של ההליך להשיב, אם אמנם ניתן להחיל על העותרים פטור מכוח סעיפים אלה, אך אנו ממליצים כי דרך זו תיבחן. לפיכך על העותרים לפנות בבקשה כאמור, ויש להניח כי היא תיבחן ברוח של בחינה חדשה. בכפיפות לאמור העתירה נדחית.
