2.העותרת, משיבים 3-2 (להלן: צרור), משיבים 5-4 (להלן: רובין) ואחרים הם בעלים במשותף של נכס מקרקעין בבני ברק (להלן: הנכס). הנכס אינו רשום בפנקס הבתים המשותפים, אך הוא מחולק בעין באופן שכל קבוצה מחזיקה ברבע משטחו. בין צרור לרובין התנהלו הליכים משפטיים בעקבות בנייה שביצעו צרור בחלק שבחזקתם. במסגרת הליכים אלו הגישו רובין עתירה לבית המשפט לעניינים מינהליים בתל אביב-יפו להורות לוועדה המקומית לבטל היתר בנייה שנתנה לצרור ולהפסיק עבודות שהתבצעו מכוחו. בית משפט לעניינים מינהליים (כב' סגן הנשיאה ע' מודריק) דחה את העתירה, אולם הורה לוועדה המקומית לוודא כי יש להותיר שביל מעבר ברוחב של 3.5 מטרים שיאפשר גישה מחלקת צרור לחלקת רובין. לאחר שניתן פסק הדין סברו רובין כי הוועדה אינה מקיימת אותו. הם פנו בבקשה לבית המשפט למתן צו המורה לצרור ולוועדה המקומית לקיימו. בית המשפט קבע כי על ב"כ המבקשים להבהיר את המסגרת הדיונית להגשת בקשה זו. ככל שהדברים עולים מהכתובים, לא הוגשו בעניין זה טענות משלימות על ידי בא כחם של רובין.
3.על רקע זה, הגישה העותרת – שלא הייתה צד להליכים בבית המשפט לעניינים מינהליים – את העתירה שלפנינו. העותרת טוענת, בתמצית, כי משלא עוגן פסק דינו של בית המשפט לעניינים מינהליים ב"תוכנית בנייה" שאושרה כדין, כשלה הוועדה מלקיים את פסק הדין באופן שפוגע בשלטון החוק, בנורמת ההגינות שבה מחוייבת רשות שלטונית, ובאינטרס של העותרת עצמה כבעלת זכויות במקרקעין.
4.בתגובותיהם לעתירה טוענים צרור והוועדה המקומית כי דין העתירה להידחות על הסף. לשיטתם, הגשת עתירה לבית משפט זה בשבתו כבית משפט גבוה לצדק אינה הדרך הראויה לאכיפת ביצוע פסק דין, ועל כן לוקה העתירה בפגם של אי מיצוי הליכים. לגופו של עניין נטען כי הוועדה מילאה אחר הוראות פסק הדין כלשונן: היא הורתה על הגשת תוכנית שינויים חדשה התואמת את פסק הדין, ופקח מטעמה ווידא כי פסק הדין מקוים במלואו.
5.דין העתירה להידחות על הסף בשל אי מיצוי הליכים וקיומו של סעד חלופי. הלכה היא כי קודם שיפנה לבית המשפט בעתירה נגד רשות מינהלית, שומה על העותר לפנות לרשות המוסמכת קודם לכן (בג"ץ 2973/10 קדיח נ' מדינת ישראל, פסקה 3 (לא פורסם, 24.5.2010)). העותרת לא הייתה צד להליכים שבמסגרתם ניתן פסק הדין שהיא מבקשת לאכפו, ומהעתירה לא ברור אם היא פנתה בעניין זה לוועדה המקומית. בא כוחה הנוכחי אמנם פנה בשם רובין, אך בכך לא די שכן הפנייה לא נעשתה מטעמה. יתרה מזו, אפילו היינו מניחים לטובת העותרת כי היא זו שפנתה לוועדה המקומית, דין העתירה להידחות מאחר שככל שלעותרת השגות על דרך פעולתה של הוועדה המקומית, עומד לה סעד חלופי בדמות הגשת עתירה חדשה לבית משפט לעניינים מינהליים (סעיף 5(1) לחוק בתי משפט לעניינים מנהליים, התש"ס-2000 ופרט 10 לתוספת הראשונה לחוק זה; השוו: בג"ץ 332/08 כוכבי נ' שר האוצר, פסקה 14 (לא פורסם, 10.11.2009)). אין ממש בהנחתה של העותרת כי בית המשפט לעניינים מנהליים נעדר סמכות לדון בעתירה מעין זו. נוכח קיומו של סעד חלופי אין מקום לכך שבית משפט זה יידרש לעניין (בג"ץ 7008/11 לרנר נ' ראש עיריית תל אביב, פסקה 2 (לא פורסם, 28.9.2011); בג"ץ 3454/08 מהדרין בע"מ נ' שר התעשייה (לא פורסם, 21.9.2008)). בנסיבות אלה, אין אנו נדרשים לגוף טענתה של הועדה המקומית המציינת – כאמור – כי פסק הדין בוצע במלואו.
6.אשר על כן, העתירה נדחית על הסף. העותרת תשא בשכר טרחת בא-כוח המשיבה 1 בסך של 5,000 ש"ח.
