פסק-דין

א. בתיווך בית המשפט, הוסכם בין הצדדים כדלקמן, ולהסכמתם ניתן בזאת תוקף של פסק הדין.

1.הקטע המסומן ג/4 בתשריט הרצוף לפסק דין זה יהרס בתוך שנה.

2.לגבי יתרת הקטע המסומן ג1 על ידי סקרלט (תוספת בחזית המזרחית), יתקיים בתוך 4 חודשים דיון בועדת משנה של הועדה המקומית, כאשר הצדדים להליך זה יוכלו להציג מסמכים ולהשמיע טענותיהם. בדיון יבורר ויוחלט, לאחר שמיעת טענות הצדדים, האם לגבי קטע זה היה היתר בר תוקף והאם ההיתר תאם את תוכנית בניין העיר שהייתה בתוקף במועד נתינתו של ההיתר. אם ההיתר לא תאם תוכנית בנייה כאמור, או שלא היה היתר יינתן צו הריסה לגבי הקטע האמור. על החלטת ועדת המשנה ניתן יהיה להגיש ערר לוועדת הערר של הועדה המחוזית.

3.אשר לקטע אותו הגדיר סקרלט ג2 (תוספת בחזית האחורית) – הרי בהתאם לקביעה שבפסק דין (שלא ניתן בזמנו לבקשת עו"ד יאראק), קטע זה ייהרס. ההריסה תהא בתוך שנה מהיום.

4.לאור חוות דעתו של סקרלט, הקטע שסומן על ידו ג3 (רצועה ברוחב משתנה עד לכ- 40 ס"מ בחזית המזרחית) – לא ייהרס.

5.על פי ההסכמה שבין הצדדים כפי שהועלתה ביום 16.9.2001 התכנית נשוא הדיון תתוקן בהתאם לחלקים שיהרסו.

ב. הצדדים הסמיכוני להכריע בשאלת ההוצאות כאמור בסעיף 79א לחוק בתי המשפט, ואני קובעת כי סנטוריום הוד השרון ישלם לשרייבר ולכהן כל אחד לחוד, 10,000 ש"ח נכון להיום. ההוצאות שנפסקו בבית המשפט המחוזי מבוטלות והערעורים נמחקים.
