אשר על כן, החלטנו לדון בבקשה כאילו ניתנה רשות ערעור והוגש ערעור על פיה. הערעור מתקבל ופסק-דינו של בית המשפט המחוזי מבוטל. התובענה מתקבלת באופן חלקי במובן זה שעל המשיבה לשלם למבקשת סכום של 218,496 ש"ח בצירוף הפרשי הצמדה וריבית מיום 18.3.2007 ועד לתשלום בפועל. המשיבה תישא, כמו כן, בשכר טרחה בסכום של 30,000 ש"ח.

פסק-דין
1.בית משפט השלום בתל-אביב-יפו (כבוד השופטת נ' רביב) קיבל תובענה כספית של המבקשת נגד המשיבה 1 (להלן – המשיבה) ודחה את התובענה ככל שמ דובר במשיבה 2. המשיבה חויבה לשלם למבקשת סכום של 218,496 ש"ח בצירוף הפרשי הצמדה וריבית מיום 1.1.1994. בית המשפט המחוזי בתל-אביב-יפו (כבוד השופטים י' ענבר, י' שבח ו ש' שוחט) קיבל את ערעורה של המשיבה, ביטל את פסק-דינו של בית משפט השלום ודחה את התובענה מחמת התיישנות. מכאן בקשת רשות הערעור שבפנינו.
2.התובענה נתבססה על שטר הון בסכום של 218,496 ש"ח שהוצא על ידי המשיבה למבקשת לפני שנים רבות. למעשה לא קיימת מחלוקת כי שטר ההון לא נפרע. זכר לקיומו של שטר ההון מצוי במאזנים של שתי החברות המעורבות משנות התשעים של המאה שעברה. התובענה עצמה הוגשה בשנת 2007. כאמור, בית המשפט המחוזי קיבל את הערעור בשל התיישנות. אנו סבורים שנפלה שגגה בעניין זה. זאת, מאחר שהמשיבה טענה כי טרם הגיע מועד פירעונו של שטר ההון. טענה מעין זו אינה מתיישבת עם טענת התיישנות, שהרי מניין תקופת ההתיישנות מתחיל במועד הפירעון. יחד עם זאת, לא ניתן לקבל טענה כי מועד הפירעון טרם הגיע אף בשנת 2007, עם הגשתה של התובענה על ידי המבקשת. בהיעדר הסכמה על מועד הפירעון, יש לומר כי המועד הגיע תוך זמן סביר, ונראה שמועד הגשת התובענה עומד במבחן זה. במלים אחרות, יש לצאת מנקודת המוצא כי בנסיבות העניין וכאשר לא נקבע מועד פירעון, כטענת המשיבה, הרי מועד הגשת התובענה הוא, בנסיבות העניין, מועד הפירעון.
3.אשר על כן, החלטנו לדון בבקשה כאילו ניתנה רשות ערעור והוגש ערעור על פיה. הערעור מתקבל ופסק-דינו של בית המשפט המחוזי מבוטל. התובענה מתקבלת באופן חלקי במובן זה שעל המשיבה לשלם למבקשת סכום של 218,496 ש"ח בצירוף הפרשי הצמדה וריבית מיום 18.3.2007 ועד לתשלום בפועל. המשיבה תישא, כמו כן, בשכר טרחה בסכום של 30,000 ש"ח.
