החלטתי לדון בבקשת רשות הערעור ברע"א 8155/12 כאילו ניתנה רשות והוגש ערעור על פי הרשות שניתנה, ולקבל את הערעור. בקשת רשות הערעור ברע"א 1263/13 נמחקת בלא שנתבקשה תשובה. הכל, כמפורט לעיל. כפי שציינתי, ההליך מוחזר לערכאה הדיונית לצורך מתן החלטה חדשה, אך ורק בשל כך שאגד העלתה בשלב מאוחר מאוד את טענת ההגנה לפי סעיף 6 לפקודת הנזיקין. היינו, התנהלותה של אגד היא זו שהובילה לעיכוב בבירור התובענה הייצוגית. לפיכך, תישא אגד בשכר טרחת עורך דין בסך 50,000 ש"ח לטובת המשיבה ברע"א 8155/12.

פסק-דין
1.המשיבה ברע"א 8155/12 (להלן – המשיבה) הגישה נגד המבקשת (להלן – אגד) בקשה לאישור תובענה ייצוגית. ההליך נוגע למדיניות קביעת התעריפים של קווי אגד בין הערים חיפה וירושלים. על פי הנטען, קיים פער משמעותי בין תעריף הנסיעה הנגבה בקווי האוטובוס הרגילים (היוצאים מן התחנות המרכזיות בשני הערים), לבין קווים המכונים "קווי מהדרין", הפועלים בין השכונות החרדיות בערים אלה. הטענה המרכזית של המשיבה הינה, כי התעריף הנגבה ב"קווי מהדרין" הינו נמוך באופן משמעותי מתעריף הנסיעה בקווים הרגילים. בכך מבצעת אגד, על פי הנטען, עוולות שונות כלפי הנוסעים בקווים הרגילים. בית המשפט המחוזי בירושלים (כבוד השופטת ת' בזק-רפפורט) קיבל ביום 27.9.2012 את בקשת האישור. בקשת רשות הערעור ברע"א 8155/12 מופנית נגד החלטה זו.
2.טענתה המרכזית של אגד בבקשת רשות הערעור הינה, כי היה על בית משפט קמא להכריע, עוד לפני אישור התובענה הייצוגית, בטענת ההגנה שהעלתה, הנסמכת על סעיף 6 לפקודת הנזיקין [נוסח חדש] (להלן – פקודת הנזיקין). סעיף זה קובע, כי "בתובענה שהוגשה על עוולה, חוץ מרשלנות, תהא הגנה שהמעשה שמתלוננים עליו היה לפי הוראות חיקוק ובהתאם להן או שנעשה בתחום הרשאה חוקית או מתוך אמונה סבירה ובתום לב בקיומה של הרשאה חוקית...". טענתה של אגד הינה, כי התעריפים הנגבים על ידה מאושרים על ידי משרד התחבורה ומכוח הוראות חיקוק שונות. על כן, טוענת אגד כי עומדת לה טענת הגנה טובה מפני התובענה הייצוגית.
3.דומה, כי נוכח מהות טענת ההגנה של אגד וחשיבותה לאופן המשך ניהול ההליך, היה מקום ללַבּנה כבר בשלב החלטת האישור. בית המשפט המחוזי התייחס אומנם לטענה וקבע כי אין מ דובר בטענת הגנה "מוחצת". עם זאת, הוא הבהיר כי על הטענה להתברר עד תום בהליך לגופו. במילים אחרות, התייחסותו של בית משפט קמא לטענת ההגנה הייתה, בסופו של דבר, בשולי הדברים (ראו פיסקה 16 להחלטתו). לטעמי, ראוי כי הטענה תתברר באופן מעמיק יותר עוד בטרם ההכרעה בבקשת האישור. זאת, נוכח חשיבות ההכרעה בה להמשך הדיון בהליך. אבהיר, כי אין לזקוף לחובתו של בית משפט קמא את האופן בו התבררה הטענה. מתברר, כי אגד העלתה את הטענה באיחור רב. בהחלטתו ציין בית משפט קמא כי הטענה "התחדשה" בשלב הסיכומים. בבקשת רשות הערעור לא הכחישה אגד כי נפל פגם בהתנהלותה הדיונית בכל הנוגע למועד העלאת הטענה (ראו סעיף 10.59 לבקשת רשות הערעור). אכן, ככלל, בשלב ההכרעה בבקשה לאישור תובענה ייצוגית אין מקום להידרש לטענות המועלות באיחור ובעיכוב רב, על ידי מי מבעלי הדין (למשל כאשר הטענה מועלית לראשונה בשלב הסיכומים ולא בכתבי הטענות העיקריים בבקשת האישור). אלא שבענייננו דומני כי טענת ההגנה שהעלתה אגד דורשת בירור מעמיק יותר בטרם יוחלט אם לאשר את התובענה הייצוגית. זאת, חרף הפגם שנפל בהתנהלותה הדיונית של אגד.
4.מן הטעמים האמורים, החלטתי להחזיר את ההליך לבית המשפט המחוזי על מנת שיברר את טענת ההגנה שהעלתה אגד מכוח סעיף 6 לפקודת הנזיקין, וייתן החלטה חדשה בבקשת האישור. סדרי הדין לצורך בירור הטענה ייקבעו על ידי בית המשפט המחוזי. ברי, כי אין מקום לפתוח מחדש את הדיון בטעמים האחרים שעל בסיסם החליט בית המשפט לאשר את התובענה הייצוגית. מיותר לציין כי איני מביע כל עמדה, ולוּ ברמז, לגבי טענת ההגנה הנזכרת או ביחס לטעמים האחרים שהצדיקו, לגישת בית המשפט, את אישור התובענה הייצוגית. ההכרעה החדשה בבקשת האישור מסורה לשיקול דעתו המלא של בית המשפט המחוזי. בנסיבות אלה, וכל עוד לא ניתנה החלטה חדשה בבקשת האישור, אין טעם לדון בטענות שהעלתה אגד ברע"א 1263/13, המופנות נגד החלטתו של בית המשפט המחוזי שלא לאפשר לה לשלוח למדינה הודעה לצד שלישי. לפיכך, ההליך ברע"א 1263/13 יימחק. טענותיה של אגד בעניין משלוח ההודעה למדינה שמורות לה. אם בקשת האישור תתקבל פעם נוספת, ואם אגד תבקש להשיג על ההחלטה החדשה, תוכל היא להשיג אף על ההחלטה לעניין סוגיית ההודעה לצד שלישי, בגדר בקשת רשות ערעור חדשה שתוגש, היה ויהיה בכך צורך.
5.החלטתי לדון בבקשת רשות הערעור ברע"א 8155/12 כאילו ניתנה רשות והוגש ערעור על פי הרשות שניתנה, ולקבל את הערעור. בקשת רשות הערעור ברע"א 1263/13 נמחקת בלא שנתבקשה תשובה. הכל, כמפורט לעיל. כפי שציינתי, ההליך מוחזר לערכאה הדיונית לצורך מתן החלטה חדשה, אך ורק בשל כך שאגד העלתה בשלב מאוחר מאוד את טענת ההגנה לפי סעיף 6 לפקודת הנזיקין. היינו, התנהלותה של אגד היא זו שהובילה לעיכוב בבירור התובענה הייצוגית. לפיכך, תישא אגד בשכר טרחת עורך דין בסך 50,000 ש"ח לטובת המשיבה ברע"א 8155/12.
