פסק-דין

שמענו בהרחבה את טענות הצדדים ולא מצאנו להתערב בפסק דינו המפורט והמבוסס של בית המשפט המחוזי. בכפוף לאמור להלן, בית המשפט לא ראה להתערב בהחלטת ועדת הערר ובקביעתה כי רוחב הכביש, על פי התכנית הינו 16 מ'. עוד קבע כי ניתן לאשר את בקשת המערערים בתיק עע"ם 8091/10 למתן היתר במתכונת שנקבעה בהחלטת ועדת הערר. כפי שקבע בית המשפט המחוזי הוועדה שקלה את כל השקולים הרלבנטיים ולא ראינו פגם בהחלטתה. כמו כן שוכנענו שכל הטענות שהועלו על ידי בא כוח הוועדה המקומית נדונו בפני ועדת הערר וניתן להם מענה בהחלטתה.

שמענו גם את בא כוח ועדת הערר כי בפועל מצב הבנייה לאורך קטע הכביש הרלבנטי הינו בהתאם לתשריטים שהיו מצויים במשרד הוועדה המחוזית והוועדה המקומית וכי למעשה אין שטחים שאינם בנויים בקטע הרלבנטי. לכך אנו מבקשים להוסיף הערה, הכרעה זו ניתנה בהתאם לבקשה להיתר בנייה ולתשתית שהייתה בפני ועדת הערר, לצורך זה בלבד, איננו קובעים איפוא מסמרות בהקשרים רחבים יותר.

אשר לטענת המערערים בעע"ם 8019/10 כי נפגעה זכותם כתוצאה מהחלטת ועדת הערר על קיומה של זכות מעבר או זיקת הנאה בחלקתם, הואיל והתרשמנו שלא ניתנה להם זכות טיעון מלאה בהיבט זה, מצאנו לנכון להחזיר את הדיון לוועדת הערר רק בנקודה זו.

בסוגיה זו בלבד מתקבל הערעור בעע"ם 8019/10.

בכפוף לאמור אנו דוחים את יתר הטענות בשני הערעורים.

אין צו להוצאות.
