פסק-דין
1.בדיון קודם שנערך הבענו דעתנו כי קיימת בעיה לגבי תעריף הארנונה נוכח הפער בסכום החיוב המושת על מרפאה ציבורית ביחס למרפאה פרטית. זאת, שכן החיוב על מרפאה ציבורית עולה באופן משמעותי על זה המוטל על מרפאה פרטית. בעקבות הערותינו הגיעו בעלי הדין בברכתנו להסדר שאלה פרטיו:
א. פסק דינו של בית המשפט לעניינים מינהליים יבוטל.
ב. החל מיום 1.1.2010 יחול על מרפאות המערערת חיוב בארנונה לפי סימול 215.
ג. המערערת תשלם בגין חוב הארנונה ליום 31.12.09 סכום של 1,575,000 ₪. הסכום ישולם תוך 30 ימים.
ד. הארנונה השוטפת לגבי שנת 2010 תשולם על פי הסיווג הנזכר (סימול 215) בניכוי הסכומים שכבר שולמו לגבי שנה זו.
ה. מבוקש ליתן תוקף של פסק דין למוסכם.
2.ניתן תוקף של פסק דין למוסכם. אין צו להוצאות.
ניתן ביום, כ"ו בתמוז תש"ע (8.7.2010).
תוקן היום, כ"ט באב תש"ע (9.8.2010).
