בין הצדדים נתגלע סכסוך בנוגע לתוקפו של הסכם מכר דירה בפרוייקט שנבנה על ידי המערערות. הורתו של הסכסוך בטופס "הצעה בלתי חוזרת" שנחתם על ידי המשיבים לרכישת הדירה ולגביו ניתנה, כעבור מספר ימים, הודעת קיבול על ידי המערערות. כחלוף כחודשיים הודיעו המערערות למשיבים על ביטול החוזה, לטענתן, משלא חתמו המשיבים על נוסח ההסכם המלא. המשיבים הגיבו למחרת במכתב בו דחו את הודעת הביטול, וכך נתגלגלו הדברים עד שהגיעו לפתחו של בית המשפט.

בית משפט קמא קבע בפסק דינו המפורט כי בין הצדדים נכרת הסכם מחייב וכי ביטול ההסכם על ידי המערערות נעשה שלא כדין. על כך נסב הערעור שבפנינו.

הממצאים והמסקנות של בית משפט קמא מקובלים עלינו ומשכך, אנו מאמצים את פסק דינו מכוח סמכותנו לפי תקנה 460(ב) לתקנות סדר הדין האזרחי, התשמ"ד-1984, ודוחים את הערעור. המערערות ישאו בשכ"ט המשיבים בסך 34,800 ₪.
