פסק-דין
השופט נעם סולברג:
1.ערעור וערעור שכנגד על פסק דינו של בית המשפט המחוזי מרכז (השופטת א' שטמר) בת"א 2211-08-07 מיום 9.5.2010, אשר ניתן בתביעותיהם ההדדיות של הצדדים בגין הפרות נטענות של הסכמים ביניהם, כתוצאה מיחסים מסחריים בתחום המוזיקה שעלו על שרטון. בית המשפט פסק כי על המערערים (המשיבים שכנגד) – מוסיקאי ידוע וחברה להפצת תקליטים שבבעלותו – לשלם למשיבים (המערערים שכנגד) – חברה לשיווק ולהפצת תקליטים – סכום של כ-700,000 ₪.
2.לא מצאנו עילה לדחות את הממצאים העובדתיים שנקבעו בפסק הדין, רובם ככולם הושתתו על שורת הסכמים שנחתמו בין הצדדים, חוות דעת, ותמלוגים ששולמו ושהיו צריכים להשתלם. הממצאים תומכים במסקנות המשפטיות שהסיק בית המשפט המחוזי ואין לגלות בהן טעות שבחוק.
3.החלטנו אפוא לדחות את הערעור ואת הערעור שכנגד, על-פי תקנה 460(ב) לתקנות סדר הדין האזרחי, התשמ"ד – 1984, פרט לנושא ההוצאות שנפסקו בבית המשפט המחוזי, מבלי להתחשב די הצורך בפער העצום שבין סכום התביעה לבין סכום פסק הדין.
4.שיקלול נושא ההוצאות בשתי הערכאות הביאנו לפסוק כי מן הסכום הפסוק יופחת סך של 100,000 ₪ להיום. פרט לכך, נדחים בזאת הערעור והערעור שכנגד.
