החלטה

השופט י' עמית:

1.הצדדים הקימו בתחילת שנת 2001 מיזם משותף להעברת שיחות טלפון בינלאומיות בין ארה"ב לירדן. כחלוף שלושה חודשים הוסכם בין הצדדים על פירוק השותפות ביניהם באופן שהמערער ירכוש את חלקו של המשיב בסכום של 30,000$ בשלושה תשלומים שווים, כאשר התשלום האחרון בסך 10,000$ ישולם ביום 30.8.2001 או באמצעות החזר מחברת קווי זהב.

המשיב טען כי המערער שילם לו 5,000$ בלבד מתוך הסך של 30,000$ ומשכך, הגיש לבית משפט השלום תביעה בסדר דין מקוצר כנגד המשיב על סך 120,990 ש"ח. בית משפט השלום קבע כי הסמכות העניינית נתונה לבית המשפט המחוזי מאחר שהסכסוך בין הצדדים נובע מפירוק שותפות, והורה על העברת התביעה לבית המשפט המחוזי (ת"א 1330/96 בבית המשפט המחוזי בתל-אביב-יפו, להלן: התביעה המקורית). כל אחד מהצדדים הגיש תצהיר עדות ראשית מטעמו, ולאחר שמיעת המשיב והמערער, קיבל בית המשפט את תביעת המשיב וחייב את המערער לשלם למשיב סך של 121,664 ₪ בצירוף הפרשי הצמדה וריבית כדין מיום הגשת התביעה (פסק דינו של השופט חאלד כבוב מיום 19.9.2010, להלן: פסק הדין הראשון).

2.עוד טרם יבשה הדיו על פסק הדין הראשון, הגיש המערער ביום 11.11.2010 תובענה לביטולו מחמת מרמה, באשר לטענת המערער, עלה בידו להשיג שתי ראיות חדשות שיש בהן כדי להפריך טענותיו של המשיב. האחת – דף חשבון של חברת קווי זהב ממנו ניתן להסיק כי קווי זהב העבירה למשיב סכום של 21,033 ₪; השניה – מסמכים המוכיחים כי למשיב קשר לחברה בשם מדווס, שהמשיב הכחיש במסגרת התביעה המקורית כל קשר אליה.

3.התביעה החדשה נדחתה על הסף בפסק דינו של השופט א' שהם מן הטעם שפסק הדין הראשון הפך לחלוט וקיים מעשה בית דין בין הצדדים. בפסק הדין נקבע כי המערער לא עמד בתנאים הנדרשים על מנת לגבור על כלל סופיות הדיון בהתאם להלכה שנקבעה בע"א 6019/07 טורג'מן נ' אחים עופר (ניהול) בע"מ (לא פורסם, 25.2.2010) (להלן: עניין טורג'מן) באשר המערער לא הציג כל טעם סביר מדוע לא ניתן היה להשיג את הראיות החדשות במהלך הדיון בתביעה המקורית.

4.על פסק דין זה נסב הערעור שבפנינו. בתמצית שבתמצית, המערער טען כי פסק הדין הראשון הושג בתרמית, ולכן, שיקולי הצדק גוברים על הכלל של מעשה בית דין המחייב סופיות הדיון.

5.לאחר שעיינו בכתבי הטענות ושמענו את טיעוני הצדדים, מצאנו לדחות את הערעור ולאמץ את פסק דינו של בית משפט קמא מכוח סמכותנו לפי תקנה 460(ב) לתקנות סדר הדין האזרחי, התשמ"ד-1984.

6.למעלה מן הצורך אוסיף ואומר כי הן בבית משפט קמא והן בערעור שבפנינו, לא הובא כל טעם או הסבר של ממש, מדוע נבצר מהמערער להשיג את הראיות החדשות במהלך כתשע שנים בהן הייתה התובענה המקורית תלויה ועומדת. תובענה לביטול פסק דין לא נועדה ל"מקצה שיפורים" ולתיקון מחדלים כאלה ואחרים של בעל הדין. לא לשם כך נועד המוסד החריג עד-מאוד של מעין משפט חוזר אזרחי, וגם אם ננקוט בפרשנות מקלה לגבי מידת השקדנות הסבירה הנדרשת במסגרת התנאי השלישי שנקבע בעניין טורג'מן (שם, פסקה 30 לפסק הדין), הרי שהמערער לא עמד בתנאי זה.

עוד אציין, כי על פניו, ספק אם יש בראיות החדשות כדי להפוך מיניה וביה את תוצאת פסק הדין הראשון. המסמך של קווי זהב יכול להעיד, לכל היותר, כי נתקבל אצל המשיב סכום של כ-20,000 ₪ מתוך החוב הכולל. אשר למסמכים המעידים לכאורה על קשר בין המשיב לבין חברת מדווס, המשיב הכחיש בדיון שבפנינו את חתימתו על מסמכים אלה, ומכל מקום, טען כי אין בהסכם פירוק השותפות כל התחייבות מצידו להעביר למשיב את מניותיו בחברת מדווס. מכאן, שספק אם יש במסמכים אלה כדי להעלות או להוריד בשאלה שהוכרעה בפסק הדין הראשון.

7.סופו של דבר שאנו דוחים את הערעור. המערער ישא בהוצאות המשיב בסך 25,000 ₪.
