באי כוח הצדדים:
אנו נכונים להגיע להסכמה כלהלן לסיום כל המחלוקות:
1.הבית המשותף ירשם בהקדם האפשרי. כל הצדדים ישתפו פעולה. הרישום יעשה תוך 18 חודש. הרישום יבוצע בכפוף לאמור בהסכם זה להלן.
2.מוסכם בזה כי חלק מהגג בשטח של 27 מטר, שטח רצוף ובאותו מפלס, עם גישה ישירה לחדר המעלית, ירשם כרכוש משותף ולמען הסר ספק הדיירים, למעט גבאי, יהיו רשאים להציב מתקנים שונים בשטח זה כגון: דודי שמש, קולטים, מנועי מזגנים. ככל שידרש להעביר צנרת למתקנים הנ"ל, גבאי או חליפו יאפשרו זאת, דרך הצד המערבי החיצוני של הבניין, ככל הניתן. דירתו של גבאי או חליפו יתקינו את מתקניהם בשטח אחר או מעל פיר המעלית לפי בחירתם. יתרת שטח הגג הקיים תרשם על שם גבאי. רוכשי הדירות מצהירים בזה כי אין להם טענה לגבי זכויות הבניה אם בכלל על הגג כולו. אין באמור לעיל כדי להביע עמדה לגבי זכויות הבניה בגג כולו ביחסים בין גבאי לרובין, וככל שקיימים לחיים יזרעאלי.
3.מוסכם בזאת כי המבואה בקומה רביעית היא בגדר רכוש משותף. עם זאת, בעלי הדירות בקומות 1-3 מסכימים להותיר את המצב הקיים בעינו אך מוסכם בזה כי יינתן מפתח לכל בעלי שש הדירות בקומות 1, 2, 3, שיאפשר להם גישה חופשית למבואת הקומה הרביעית.
4.גבאי או חליפו מתחייבים בזה כי ככל שיידרש להכנס לדירתו לשם תיקון, הצבה, החלפה, תיקון שוטף וכיוצ"ב של המתקנים שיוצבו על ידי הדיירים או על ידי בעלי הדירות ברכוש המשותף בגג (כאשר הדבר לא מתאפשר דרך הפיר הקיים) – לאפשר זאת, ככל שניתן בתוך 24 שעות.
5.האמור לעיל הוא לסיום סופי ומוחלט של הסכסוכים בין בעלי הדירות מושא פסק דינו של בית המשפט קמא.
6.הערעור והערעור שכנגד יימחקו ללא צו להוצאות והפיקדונות יוחזרו לבעליהם.
