פסק-דין

בהמשך לישיבת קדם המשפט מיום 18.7.2013 ולאור הודעתו מיום 6.8.2013 של המערער בע"א 7740/12 (להלן: המערער) ניתן בזה פסק דין כלהלן, חלף פסק דינו של בית המשפט המחוזי.

1.כל ההוצאות שהושתו על המערער בפסק דינו של בית משפט קמא – יבוטלו.

2.סכום הנזק כפי שנקבע על ידי בית משפט קמא – יעמוד על כנו.

3.למעט המשיב 1 (שי חן), המשיב 2 (בן יוסף יגאל) והמשיב 3 (קויטון רונן - כל המשיבים האחרים יופטרו מחבותם.

4.על אף האמור בסעיף 3 לעיל, ונוכח הנסיבות המיוחדות של המקרה, מוסכם בזה כי המערער יהיה פטור מלהשיב למי מהמשיבים האחרים סכומים שכבר שולמו לו על פי פסק דינו של בית המשפט המחוזי. בנוסף, ולאור ביטול החיוב בהוצאות, תוסיף המשיבה 7 (חברת כלל) ותשלם למערער תוך 30 יום את הסך של 25,000 ₪, שהוא סכום ההוצאות שנפסק לזכות המשיבה 4 (אולמי הנסיכה) ואשר קוזז על ידי כלל בהיותה גם מבטחתה של המשיבות 6-5 (חוצות המפרץ).

5.המשיב 2 והמשיב 3 ישלמו למערער הסך של 50,000 ₪ כל אחד בנפרד (סה"כ – 100,000 ₪) וזאת עד ליום 19.2.2014. לא שולם התשלום הנ"ל במועדו ובשלמותו על ידי מי מהמשיבים 2 או 3, יעמוד החיוב על הסכום של 100,000 ₪ בנפרד, במקום הסך של 50,000 ₪.

מובהר בזה כי הכפלת הסכום אינה בגדר פיצוי מוסכם, אלא נובעת, מלכתחילה, ממהותה של הפשרה, ולאור הסיכון הממשי בערעור, כפי שהובהר למשיבים 2 ו-3 בישיבת קדם המשפט, ולפיו הם עשויים להימצא בסופו של דבר חבים "ביחד ולחוד" על מלוא סכום הנזק שנפסק לזכות המערער בבית משפט קמא.

6.נוכח הנסיבות המאוד מיוחדות של המקרה, יבוטל חיובו של המערער ביתרת האגרה בגין ההליך בבית המשפט המחוזי.

7.פסק דין זה ניתן בהיעדר הצדדים, אשר בישיבת קדם המשפט כבר נתנו את הסכמתם למתווה הכללי של הפשרה שהוצעה. עם זאת, מאחר שההסדר המוצע לא כלל את האמור בסעיף 4 סיפא ואת מועד החיוב שנקבע בסעיף 5 (בניגוד למנגנון שהוצע על ידי המערער בהודעתו מיום 6.8.2013) – הרי שכל צד רשאי יהיה לעתור לביטול פסק הדין תוך 30 יום מהיום, שאם לא כן, יעמוד פסק הדין על כנו. נוכח נסיבות המקרה, אין לי אלא להמליץ לצדדים שלא לעשות שימוש בזכות זו.
