ערעור על פסק דינו של בית המשפט המחוזי תל אביב מיום 18.10.2011 בתיק א -001730/05 שניתן על ידי כבוד הרשמת א' נחליאלי-חיאט

השופט י' עמית:

המערער הגיש תביעת נזיקין על סך 5 מליון ₪ כנגד המדינה וכנגד המשיבים 11-3 באופן אישי בגין נזקים שנגרמו לו, לטענתו, בעקבות חיפוש והחרמה של מסמכים שנתפסו בביתו, ואשר לטענת המדינה מקומם בגנזך המדינה.

התביעה כנגד המשיבים 11-3 נמחקה בפסק דין חלקי לאחר שהמדינה מסרה הודעה לפיה אין מקום להחרגת החסינות של עובדי ציבור לפי סעיף 7א לפקודת הנזיקין [נוסח חדש].

על כך הוגש הערעור שבפנינו.

פסק הדין החלקי ניתן ביום 18.10.2011 אך מתברר כי כבר ביום 15.4.2010 ניתן כנגד המערער צו כינוס בתיק פשיטת רגל המתנהל כנגדו, ועד עתה המערער לא קיבל אישור בית המשפט של פשיטת רגל לניהול ההליך.

הודעת המנהל המיוחד שנתמנה למערער, על כך שטרם ניתן אישור בית המשפט של פשיטת רגל, נמסרה לתיק בית המשפט כבר בחודש יוני 2012 ובעקבות כך בוטלה ישיבת קדם המשפט שהייתה אמורה להתקיים בתיק. למרות זאת, ולמרות שבפני המערער עמדו חודשים ארוכים לפנות ולקבל אישור בית המשפט של פשיטת רגל לניהול ההליך דכאן (ואף למעלה משנתיים לאחר צו הכינוס) – אישור כאמור טרם ניתן.

בנסיבות אלה, אין מקום כי הערעור ימשיך להיות תלוי ועומד, ואנו מורים על מחיקת הערעור.

מובן כי אם וככל שיקבל המערער אישור בית משפט של פירוק לניהול ההליך, יהא רשאי להגיש התביעה מחדש.
