השופט י' עמית:
המערער הגיש תביעה כספית כנגד המשיבים בגין עסקת מקרקעין (ככל שעולה מכתב התביעה, מעמדו של המערער כתובע, נובע מהמחאת זכויות שנעשתה לזכותו, לטענתו).
בית משפט קמא מחק את התביעה מחוסר מעש בקובעו כי ההליכים בתיק מעוכבים מאז יום 18.10.2010 בשל צו כינוס שניתן כנגד המערער, וטרם ניתן אישור בית משפט של פשיטת רגל לניהול ההליך, וכי למרות החלטות קודמות של בית המשפט המערער לא הסביר מה מעכב מתן ההחלטה והסתפק בדיווח לקוני כי טרם ניתנה החלטה. בקשה לעיון מחדש נדחתה אף היא על ידי בית משפט קמא בקובעו כי אין מקום לשינוי החלטתו "שניתנה לאחר ארכות רבות מאוד שניתנו לתובע להסדיר את ניהול התביעה".
על פסק דין זה נסב הערעור שבפנינו.
פסק הדין ניתן ביום 3.7.2011 אך מתברר כי כבר ביום 15.4.2010 ניתן כנגד המערער צו כינוס בתיק פשיטת רגל המתנהל כנגדו, ועד עתה המערער לא קיבל אישור בית המשפט של פשיטת רגל לניהול ההליך.
הודעת המנהל המיוחד שהתמנה למערער, על כך שטרם ניתן אישור בית המשפט של פשיטת רגל, נמסרה לתיק בית המשפט כבר בחודש יוני 2012, ובעקבות כך בוטלה ישיבת קדם המשפט שהייתה אמורה להתקיים בתיק. למרות זאת, ולמרות שבפני המערער עמדו חודשים ארוכים לפנות ולקבל אישור בית המשפט של פשיטת רגל לניהול התביעה, ולמרות ארכות חוזרות ונשנות שניתנו לו על ידי בית משפט קמא – לא הומצא האישור הנדרש.
בנסיבות אלה, אין מקום כי הערעור ימשיך להיות תלוי ועומד, ואנו מורים על מחיקת הערעור.
מובן כי אם וככל שיקבל המערער אישור בית משפט של פירוק לניהול ההליך, יהא רשאי להגיש התביעה מחדש.
