1.הצדדים, שכנים המתגוררים זה מעל זה, מתכתשים מאז סוף שנות השבעים של המאה הקודמת בכל הערכאות המשפטיות (ראו ע"א 538/80 דרחי נ' כורש, פ"ד לו(3) 498 (1982)).
בשנת 1995 הגישו המשיבים 2-1 (להלן: המשיבים) בקשה להיתר בניה, ובעקבות התנגדות המערערים הגיעו הצדדים להסכם פשרה ביום 20.3.1996 (במסגרת ת"א 78017/95 בפני כב' השופטת (כתוארה אז) הילה גרסטל – להלן: הסכם הפשרה). בהתאם להסכם הפשרה, נקבע כי גרם המדרגות החיצוניות שביקשו המשיבים להקים יהיה "...במיקום שיאושר על ידי הועדה המקומית ובכפוף לקבלת היתר בניה כדין".
2.מני אז, מנהלים המערערים אין-ספור הליכים, בערכאות שונות, בניסיון למנוע את הקמת המדרגות (אשר ביני לביני כבר נבנו). בהליך מושא הדיון בבית משפט קמא, טענו המערערים כי בהסכם הפשרה נפלה טעות ועל כן יש לבטל את הסכם הפשרה. אציין, כי המערערים טענו תחילה כי הטעות היא בפסק הדין גופו, ובהמשך נטען כי המדובר בטעות שנפלה בהסכם הפשרה לגבי אומד דעת הצדדים.
3.בית משפט קמא דחה את התובענה בשל מספר טעמים, בין היתר מאחר שחלף מועד הערעור, התיישנות, השתק ומעשה בית דין ואנו מאמצים נימוקים אלה מכוח סמכותנו לפי תקנה 460(ב) לתקנות סדר הדין האזרחי, התשמ"ד-1984.
לא למותר לציין, כי תובענה קודמת שהגישו המערערים נמחקה, בהסכמתם, ובדיון שהתקיים ביום 3.4.2008 (ה.פ. 1636-12-07 בית משפט מחוזי מרכז) הגיעו הצדדים להסכמה, שקיבלה תוקף של פסק דין, כלהלן:
"מוסכם עלינו שההסכם שאושר וקיבל תוקף של פסק דין בפני כבוד השופטת גרסטל בשנת 1996 (הסכם הפשרה – י"ע) תקף ומחייב אותנו כאמור בו. עוד מוסכם עלינו, כי אם המבקשים (המערערים – י"ע) יגישו תובענה בעניין זה כנגד המשיבים, בין לבית המשפט ובין בדרך של פניה לרשות מוסמכת אחרת, ישלמו המשיבים למבקשים את הוצאות המשפט בגין תיק זה בסך של 15,000 ₪ בתוספת מע"מ".
על אף פסק דין זה, הוגשה התובענה דכאן, לא לפני שהמערערים נקטו במספר הליכים נוספים, הן כנגד הועדה המקומית והן כנגד המשיבים.
4.אשר על כן, אנו דוחים את הערעור.
המערערים ישאו בהוצאות המשיבים 2-1 בסך 20,000 ₪ ובהוצאות המשיבה 3 בסך 10,000 ₪.
