סיכומו של דבר שלעתירה אין כל יסוד כיום לאחר שברור כי לא תבוצע בנייה בתחומה של שמורת הטבע, הגם שאותו שטח בעייתי כלול בתוכניות ואלה מתירות בנייה. על כן, דין העתירה להידחות וכך מוחלט. העותרים ישאו יחד ולחוד בשכר טרחה בסכום של 20,000 ש"ח למשיבים 8-1 ובאותו סכום למשיבים 15-9.

פסק-דין
1.בעתירה שבפנינו ביקשו העותרים כי ייקבע שעבודות בנייה שונות שהתבצעו בתחומי היישוב בית אריה שבאזור יהודה ושומרון נעשות שלא כדין, שכן הן מבוססות על תוכנית הנגועה בפגם קשה. הפגם בו מ דובר הוא שחלקה של התוכנית מתייחס לשטח שנקבע בצו כי הוא שמורת טבע. יצוין, כי העתירה דנא באה בעקבות עתירה קודמת (בג"ץ 3009/13).
2.אין כיום מחלוקת כי אכן נפלה שגגה בתוכנית הנזכרת וכנראה בתוכניות נוספות, שכן התוכניות התירו בנייה בשטח מסוים שנכלל בשמורת טבע. ברם התברר, כי הרשויות השונות מודעות כיום לפגם שנפל בתוכניות ועל כן הן הודיעו שלא תותר בנייה באותו שטח הכלול בתוכניות ואשר נמצא בתחומה של שמורת הטבע. משכך, ברי כי אין עוד מקום לעתירה. יצוין, כי שוכנענו שלפי עיקרון העיפרון הכחול ניתן להפריד בין השטח הבעייתי לבין מותר השטחים שבתחומתן של התוכניות, אותם שטחים שאינם כלולים בשמורת הטבע.
3.במהלך הדיון בפנינו ביקש פרקליטם של העותרים להעלות טענות נוספות, שלא נכללו בעתירה. כך למשל הוא טען, כי כיום אין אפשרות גישה לשמורת הטבע ולא הוסדרה חנייה למבקרים בשמורה. טענה זו ואחרות כמותה לא עלו בעתירה ולכן לא ראינו צורך להידרש להן, ובכל מקרה לא נתבקש כל סעד בעניין.
4.סיכומו של דבר שלעתירה אין כל יסוד כיום לאחר שברור כי לא תבוצע בנייה בתחומה של שמורת הטבע, הגם שאותו שטח בעייתי כלול בתוכניות ואלה מתירות בנייה. על כן, דין העתירה להידחות וכך מוחלט. העותרים ישאו יחד ולחוד בשכר טרחה בסכום של 20,000 ש"ח למשיבים 8-1 ובאותו סכום למשיבים 15-9.
