ערעור על החלטת הרשם ג' שני (רע"א 515/14 – ה') מיום 8.4.2014, במסגרתה דחה את בקשתו של המערער לעיון חוזר בהחלטתו (רע"א 515/14 – א') מיום 2.3.2014.

1.במסגרת בקשת רשות הערעור שהגיש המערער ביקש פטור מתשלום אגרה והפקדת עירבון. ביום 2.3.2014 הרשם קיבל את בקשתו לפטור מאגרה ודחה את הבקשה לפטור מהפקדת עירבון. עם זאת, הפחית הרשם את סכומו של העירבון לסך של 1,500 ש"ח, זאת נוכח מצבו הכלכלי הקשה של המערער, שבאשר לו אין מחלוקת בין הצדדים, תוך שציין שאף שההליך העיקרי הוא בקשה למתן רשות ערעור וסיכוייו אינם גבוהים, אין לומר שאינו מגלה עילה כלל. המערער הגיש בקשה לעיון חוזר בהחלטה. בהחלטתו בבקשה זו מיום 8.4.2014 קבע הרשם כי המערער יוכל להפקיד את העירבון בשני תשלומים שווים בתאריכים נקובים, אך לא מצא להפחית את שיעור העירבון שנקבע, בין השאר לאור התחשבות באינטרס המשיבה בקיומו בהליך ב"גלגול שלישי" כאמור.

2.מכאן הערעור שלפניי, במסגרתו שב וטוען המערער כי מצבו הכלכלי קשה, קצבתו נמוכה מאוד, ואף מעוקלת לעיתים, וכי אין מקום למנוע ממנו את הגישה לערכאות אך בשל עוניו. עוד הוא מציין כי הרשמת ל' בנמלך בחנה את עניינו ומצאה שסיכויי ההליך מספקים והורתה לאפשר לו להגיש את הבקשה העיקרית, למרות שאיחר במועד, ויש ללמוד מכך על סיכויי ההליך גם בבחינת בקשת הפטור מעירבון (בש"א 7600/13).

3.דין הערעור להידחות. לא מצאתי פגם המצדיק התערבות בהחלטת הרשם. כידוע, שיקול דעתו של הרשם רחב, ולא בנקל תתערב בו ערכאת הערעור (ראו: בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012); בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013)).

4.במסגרת בקשה לפטור מהפקדת עירבון, על המבקש הנטל להוכיח שני תנאים מצטברים: היעדר מסוגלות כלכלית וסיכויי ההצלחה בערעור (ראו: בש"א 1528/06 ורנר נ' כונס הנכסים הרשמי, פסקה 7 (17.10.2007)). ברי כי מצבו הכלכלי של המערער אינו מן המשופרים. עם זאת, מבין השורות עולה כי יש ביכולתו של המערער להסתייע בקרוביו ובני משפחתו לשם הפקדת העירבון, ולראיה כותב אף המערער עצמו כי במסגרת תוכניתו המקורית ליציאה לחו"ל, אשר הולידה לדבריו את התביעה, "כלכלת המסע והשהייתה ממומנת ע"י משפחתו ומכריו". במצב עניינים זה, ניתן להניח שיוכלו הם לסייע לו גם בהפקדת סכום העירבון המתון. בנוסף, כפי שהרשם ציין בצדק, יש לזכור כי מדובר בהליך ב"גלגול שלישי", ואף שלא ניתן לומר שאינו מגלה עילה, סיכוייו אינם גבוהים. יתר על כן, אין ללמוד מהחלטת הרשמת בנמלך בבש"א 7600/13, לענייננו, ושם ההכרעה התקבלה תוך איזונם של שיקולים שאינם רלוונטיים לשאלת קביעת העירבון ומתן פטור מהפקדתו. בסיכומם של דברים, מצאתי כי החלטתו של הרשם בבקשה לעיון חוזר, להותיר את העירבון על סך של 1,500 ש"ח ולפצלו לשני תשלומים שווים, איזנה נכונה בין השיקולים השונים.

5.סוף דבר, הערעור נדחה. המערער יפקיד את העירבון בשני תשלומים שווים, הראשון תוך 21 יום מהמצאת החלטה זו לידיו, והשני תוך 42 יום מהמצאת החלטה זו לידיו. לא יעשה כן, יירשם ההליך לדחייה ללא כל הודעה נוספת.
