ערעור על החלטתה של כבוד רשמת בית המשפט העליון ל' בנמלך מיום 11.5.2014 בדנ"א 1990/14

ערעור על החלטת הרשמת ל' בנמלך (דנ"א 1990/14) מיום 11.5.2014, במסגרתה דחתה את בקשת המערער לפטור מתשלום אגרה והפקדת עירבון, והעמידה את תשלום האגרה על סכום של 500 ש"ח ואת הפקדת העירבון על סכום של 15,000 ש"ח.
1.המערער הגיש עתירה לקיום דיון נוסף בע"א 7113/11 שניתן ביום 27.2.2014. במסגרת עתירתו הגיש גם בקשה לפטור מתשלום אגרה והפקדת עירבון. הרשמת דחתה את בקשתו, אך לאחר שאיזנה את השיקולים השונים הפחיתה את הסכומים לתשלום והפקדה כאמור ברישה, וזאת נוכח טענות העותר, לפיהן הוא מתקיים מקצבת נכות ונתון בהליכי פשיטת רגל, אך גם העובדה שהמערער לא צירף תיעוד מספק לטענותיו, ובעבר כבר הפקיד פיקדון בערעור שהגיש לבית משפט זה (ע"א 6074/12), לאחר שהובהר לו כי אין די בפירוט ותיעוד דומה לזה שהגיש עתה, כדי להעניק פטור מתשלום אגרה או הפקדת עירבון. עוד שקלה לעניין זה הרשמת את סיכויי ההליך הנמוכים ואת העובדה שהמערער לא התייחס לאפשרות גיוס סכום העירבון באמצעות סביבתו הקרובה.
2.המערער הגיש בקשה לעיון חוזר בהחלטה האמורה, אליה הוסיף מסמכים נוספים. ביום 28.5.2014 דחתה הרשמת בקשה זו, תוך שציינה כי לא חל כל שינוי נסיבות, ושוב לא פרש המערער תשתית עובדתית מלאה להוכחת מצבו הכספי. יצוין כי עוד טרם מתן החלטה בבקשה לעיון חוזר, שילם המערער ביום 26.5.2014 את האגרה שנקבעה על ידי הרשמת.
3.מכאן הערעור שלפניי, המופנה כלפי גובה העירבון בלבד. במסגרת הערעור טוען המערער כי הוא מתקיים בקושי רב מקצבת זקנה ואין לו מקורות הכנסה נוספים. עוד הוא טוען כי הוא מתגורר בבית ישן, מבלי שיש מישהו שמטפל בו, מצבו הבריאותי והנפשי חמור, ובני משפחתו אינם מוכנים לסייע לו בהפקדת העירבון. עוד הוא טוען כי בהליך קודם בבית משפט זה קיבל פטור מהפקדת עירבון.
4.דין הערעור להידחות. לא מצאתי פגם המצדיק התערבות בהחלטת הרשם. כידוע, שיקול דעתו של הרשם רחב, ולא בנקל תתערב בו ערכאת הערעור (ראו: בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012); בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013)).
5.במסגרת בקשה לפטור מהפקדת עירבון, על המבקש הנטל להוכיח שני תנאים מצטברים: היעדר מסוגלות כלכלית וסיכויי ההצלחה בערעור (ראו: בש"א 1528/06 ורנר נ' כונס הנכסים הרשמי, פסקה 7 (17.10.2007)). מעיון בערעור עולה כי הוא זהה כמעט לחלוטין לבקשה לעיון חוזר שהגיש המערער לרשמת, ואין בו כל טענה הנוגעת לאופן מוטעה בו הפעילה הרשמת את שיקול דעתה בהקשר הוכחת התנאים האמורים. לגופו של עניין, נותרו בעינן קביעותיה של הרשמת לפיהן המערער לא חשף את כל מצבו הכספי ואין די במסמכים שצירף כדי לפטור אותו מהפקדת עירבון. עוד אציין כי המערער אף לא הסביר את אופן הפקדת העירבון בע"א 6074/12, לא בבקשתו לעיון חוזר ולא בערעורו, ומהו אותו הליך בו קיבל פטור מהפקדת עירבון בעבר. לאחר שבחנתי את מכלול השיקולים ואת טענות המערער, יחד עם סיכויי ההליך הנמוכים נוכח מהותו, עתירה לקיום דיון נוסף, מצאתי כי הרשמת איזנה ביניהם היטב בהחלטתה ואין מקום להתערבות בה.
6.סוף דבר, הערעור נדחה. המערער יפקיד את העירבון תוך 21 יום מהמצאת החלטה זו לידיו. לא יעשה כן, יירשם ההליך לדחייה או יימחק ללא הודעה נוספת.
