1.בהחלטה מיום 16.3.2014 דחה הרשם את בקשת המערערים לפטור מהפקדת עירבון, מאחר ששילמו את האגרה, הם מיוצגים על ידי עורך-דין ואף הפקידו סכומי כסף בערכאות הקודמות. עוד ציין הרשם כי המערערים עובדים בחברות הזנק, והמערער 1 הוא עורך-דין ומנהל בחברת הזנק, והם לא הציגו תשתית מלאה ומבוססת על פיה אינם יכולים להעמיד עירבון כפי שהדין קובע. לכן קבע שהעירבון יופקד תוך 10 ימים ממועד המצאת החלטתו וחייב את המערערים בהוצאות המשיב בסך 1,500 ש"ח. בהחלטה מיום 27.3.2014 דחה הרשם את בקשת המערערים לעיון חוזר בציינו, כי אף שהבקשה לעיון חוזר אינה "מקצה שיפורים" לבקשה המקורית ודי בכך, גם לגופו של עניין אין במסמכים הנוספים שהגישו המערערים במסגרתה, כדי להביא אותו לשנות ממסקנתו.

2.מכאן הערעור שלפניי, במסגרתו טוענים המערערים כי די במסמכים שצורפו לבקשת הפטור מעירבון כדי לקבוע שאין באפשרותם לשלמו, והמסמכים שהוצגו במסגרת הבקשה לעיון חוזר אך מוסיפים עליהם. עוד טוענים המערערים לאי דיוקים בתגובת המשיב לבקשה, ולהיעדר תצהיר שאמור ללוות אותה.

3.דין הערעור להידחות. לא מצאתי פגם המצדיק התערבות בהחלטת הרשם. כידוע, שיקול דעתו של הרשם רחב, ולא בנקל תתערב בו ערכאת הערעור (ראו: בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012); בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013)).

4.במסגרת בקשה לפטור מהפקדת עירבון, על המבקש הנטל להוכיח שני תנאים מצטברים: היעדר מסוגלות כלכלית וסיכויי ההצלחה בערעור (ראו: בש"א 1528/06 ורנר נ' כונס הנכסים הרשמי, פסקה 7 (17.10.2007)). במסגרת בחינת המסוגלות הכלכלית, נבדקת גם אפשרותו של המבקש להסתייע בחבריו וקרוביו לשם הפקדת העירבון. לדעתי, אין די בפרטים שהביאו המערערים כדי להוכיח שאין ביכולתם לגייס כספים מחבריהם וקרוביהם לטובת הפקדת העירבון שנקבע, אלא להיפך, המערערים מסתייעים בהוריי המערער 1 באופנים שונים (ראו: בש"א 6411/11 שני נ' עו"ד ארז חבר, נאמן לנכסי החייב (3.10.2011)). עוד יש לציין כי המערערים עובדים ויש להם פוטנציאל השתכרות גבוה. באשר לסיכויי ההליך, לא אכביר במילים על סיכויי הליך "בגלגול שלישי", ורק אדגיש שמדובר בבקשת רשות ערעור, שהוגשה על בקשת רשות ערעור על החלטת ביניים של בית משפט השלום, שנדחתה בבית המשפט המחוזי. אמנם, נקבע שעל החלטות מסוג זה ניתן להגיש בקשת רשות ערעור, אך יש להתחשב בכך שההליך העיקרי בבית משפט השלום עדיין מתנהל ובכך שמדובר בערכאה שלישית שתדון בבקשת ביניים בהליך (ראו: רע"א 34/89 גלצר נ' גלצר, פ"ד מג(1) 329 (1989); רע"א 3235/14 פייגנבוים נ' פייגנבוים (10.6.2014)). במצב עניינים זה, החלטות הרשם לדחות את הבקשה והבקשה לעיון חוזר, מאזנות נכונה בין השיקולים השונים.

5.סוף דבר, הערעור נדחה. המערערים יפקידו את העירבון עד ליום 20.7.2014. לא יעשו כן, יירשם ההליך לדחייה ללא כל הודעה נוספת.
