1.המערער הגיש לבית משפט זה בקשה למתן רשות ערעור על החלטת בית המשפט המחוזי בבאר שבע (ת"א 39924-04-14, הנשיא י' אלון) מיום 29.4.2014 במסגרתה דחה את בקשתו לפטור מאגרה בתביעה על סך 100,000,000 ש"ח שהגיש נגד חמישה בנקים והיועץ המשפטי לממשלה, בטענה שהבנקים מסרבים לפתוח חשבון בנק לתרומות לטובת בניית בית המקדש, משימה שהטיל עליו אלוהים עת התגלה בפניו.
2.יחד עם הבקשה למתן רשות ערעור, הגיש המערער גם בקשה לפטור מאגרה. בהחלטתה בבקשה, ציינה הרשמת כי כיוון שבקשת רשות הערעור מכוונת להחלטה הקשורה בתשלום אגרה, פטור המערער מתשלומה לפי תקנה 20(4) לתקנות בתי המשפט (אגרות), התשס"ז-2007. בנוסף, ציינה שהמערער לא טען לעניין העירבון, לא הציג מסמכים מספקים לשם מתן פטור מעירבון וכן הוסיפה כי סיכויי ההליך על פניהם אינם טובים. אף על פי כן, קבעה את העירבון על סכום מתון של 5,000 ש"ח.
3.מכאן הערעור שלפניי, במסגרתו המערער חוזר על טענותיו מבקשת רשות הערעור והבקשה לפטור מאגרה, אך מוסיף מספר מסמכים נוספים. תמצית טענותיו לעניין יכולתו הכלכלית, היא שמחיקת חשבון התרומות על ידי המשיב 1 שללה ממנו את פרנסתו, שהיא כאמור בפסקה 1 לעיל – תרומות לבניית בית המקדש.
4.דין הערעור להידחות. לא מצאתי פגם המצדיק התערבות בהחלטת הרשמת. כידוע, שיקול דעתו של הרשמת רחב, ולא בנקל תתערב בו ערכאת הערעור (ראו: בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012); בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013)).
5.המערער לא הגיש בקשה לפטור מהפקדת עירבון. לאחר שקבעה הרשמת את העירבון, השיג הוא על הסכום לפניי, אך עשה זאת בצירוף מסמכים שלא היו בפני הרשמת. תקנה 457 לתקנות סדר הדין האזרחי, התשמ"ד-1984 קובעת כי בעל דין אינו זכאי להביא ראיות נוספות בערעורו, אלא אם קיבל רשות לכך. אף אם אניח שרשות לכך יכולה להינתן בעניינו של המערער, לאחר שעיינתי במסמכים שלא היו בפני הרשמת, נחה דעתי שאין בהם כדי לסייע למערער בטענתו. לגופו של עניין, נקבע עירבון מתון, שאין מקום להתערבות בו, ודאי שלא נוכח סיכויי ההליך כפי שעולים מהחלטת בית המשפט המחוזי ועיון בבקשה למתן רשות ערעור.
6.סוף דבר, הערעור נדחה. המערער יפקיד את העירבון עד יום 27.7.2014. אף על פי כן, ולפנים משורת הדין, אם בידי המערער מסמכים אחרים אשר מעידים על קשייו הכלכליים לעמוד בתשלום, יוכל הוא להגישם לרשמת, אשר תבחן מחדש את החלטתה לאורם. לא יעשה כן עד המועד האמור ברישה של פסקה זו, יירשם ההליך לדחייה בתום המועד האמור ללא כל הודעה נוספת.
