ערעור על החלטת הרשמת ל' בנמלך (ע"א 3327/14 – א') מיום 22.6.2014, במסגרתה דחתה את בקשת המערער לפטור מעירבון, אך הפחיתה אותו מסך של 30,000 ש"ח לסך של 15,000 ש"ח לנוכח נסיבותיו האישיות, מצבו הרפואי ומעמדם היחסי של הצדדים.

1.בהחלטתה ציין הרשמת כי בבעלות המערער דירת מגורים ששוויה לא צוין, וכן לא הובהר מדוע לא ניתן ליטול הלוואה כנגדה. כן עמדה על כך שבחשבונו יתרת זכות לא מבוטלת. עוד ציינה הרשמת כי המערער לא פירט באופן מספק את הוצאות התא המשפחתי ולא צירף אסמכתאות להוכחת טענותיו אלה. באשר לטענות המערער כי אינו יכול להסתייע בסביבתו הקרובה לשם תשלום העירבון קבעה הרשמת כי אלה נטענו ללא פירוט ותיעוד, וכן ללא אסמכתאות התומכות בהן (בפרט ביחס לחובותיו של המערער לאחיו בשל הלוואות עבר). עם זאת, כאמור ברישה, הפחיתה הרשמת את העירבון שנקבע במחצית.

2.מכאן הערעור שלפניי, במסגרתו טוען המערער כי אין ביכולתו לשלם אף את סכום העירבון המופחת. לטענתו, מצבו הבריאותי חמור והוא סובל מנכות רפואית ותפקודית בשיעור 100%. בשל כך מתקיים הוא מקצבאות של הביטוח הלאומי ופנסיה. רעייתו אף היא במצב בריאותי קשה ואינה מקבלת קצבה כלשהי. עוד טוען המערער כי אינו עובד משנת 1995 ומאז מצבו החמיר ונגרמו לו הפסדי שכר משמעותיים. עוד הוא עומד על הוצאות וחובות שונים שיש לו ומוסיף כי הכסף שנמצא בחשבונו נועד לממן את טיפוליו הרפואיים והוצאות בלתי צפויות אחרות וכי הוא מחויב לחסוך אותו.

3.דין הערעור להידחות. לא מצאתי פגם המצדיק התערבות בהחלטת הרשם. כידוע, שיקול דעתו של הרשם רחב, ולא בנקל תתערב בו ערכאת הערעור (ראו: בשג"ץ 4934/14 גורנשטיין נ' הכנסת, פסקה 13 (21.7.2014) (להלן: עניין גורנשטיין)).

4.המערער לא הצליח להוכיח שהוא נעדר מסוגלות כלכלית להפקדת הסכום שנקבע לעירבון וזה אחד משני התנאים המצטברים לקבלת פטור מההפקדה (ראו: עניין גורנשטיין, בפסקה 10). למערער יתרת זכות משמעותית בחשבונו, וכן דירת מגורים בבעלותו. הוא לא הצליח להבהיר בערעורו את התהיות שהעלתה הרשמת באשר להיעדר הפירוט והתיעוד בבקשתו. אציין גם כי לאחר עיון באסמכתאות שכן צורפו לבקשה, אכן אין בהן די כדי לקבוע שהמערער נזקק לפטור האמור, והן מותירות שאלות רבות ללא תשובה באשר למצבו הכלכלי של המערער.

5.באשר לאי יכולתו להסתייע בסביבתו הקרובה לשם הפקדת העירבון, המערער לא סיפק נימוק מספק גם בערעורו לעניין זה, אף שהרשמת הבהירה את הקשיים שעולים מטענותיו (ראו: בש"א 6411/11 שני נ' עו"ד ארז חבר, נאמן לנכסי החייב (3.10.2011)). במצב עניינים זה, ומהטעמים שמנתה הרשמת בהחלטתה, ההחלטה לדחות את הבקשה לפטור תוך הפחתת סכום העירבון, מאזנת לדעתי נכונה בין השיקולים השונים. מחד גיסא, מקלה את גישתו של המערער לערכאה ומאידך גיסא מספקת ערובה הולמת למשיבים על הוצאותיהם.

6.לפני סיום, אעיר שרק לאחרונה דנתי בערעור שהגישה באת כוחו של המערער, עו"ד איצקוביץ', בעניין דומה (בש"א 4095/14 מאיר נ' משרד הבריאות (24.6.2014) (להלן: עניין מאיר)). גם בעניין מאיר ציין הרשם את החוסרים בבקשתו של המערער שם, ובערעור לא נכלל כל נימוק מבהר לחוסרים אלו. אף כי איני מטיל ספק במקצועיותה של באת כוחו של המערער, ראויה בעיני ההקפדה על הכללים הדיוניים בבקשות לפטור מהפקדת עירבון, בייחוד כאשר מדובר באסמכתאות, פירוט ותיעוד. אין ספק שלמערער כאן וגם בעניין מאיר קשיים רבים, וליבי עם מצבם הבריאותי והפיזי הקשה, כמו גם עם יחסי הכוחות בינם לבין המשיבים (שזהים בשני הערעורים), אך מבלי שיפעלו כנדרש, וכאשר הם טוענים טענות בעלמא – אין מקום להיטיב עימם מעבר לקביעת הרשמת כאן (והרשם ג' שני בעניין מאיר).

7.סוף דבר, הערעור נדחה. משכך מתייתרת גם הבקשה לעיכוב ביצוע שצורפה לערעור. המערער יפקיד את העירבון עד ליום 10.8.2014. לא יעשה כן, יירשם ההליך לדחייה ללא כל הודעה נוספת.
