ערעור על החלטתו של כבוד רשם בית המשפט העליון ג' שני מיום 1.7.2014 ברע"א 4123/14

ערעור על החלטת הרשם ג' שני (רע"א 4123/14 – ב') מיום 1.7.2014 במסגרתה דחה את בקשתו של המערער לעיון חוזר בהחלטתו מיום 12.6.2014, בה דחה הרשם את בקשתו לפטור מתשלום אגרה והפקדת עירבון, אך הפחית את סכום העירבון לסך של 4,000 ש"ח.
1.המערער הגיש לבית משפט זה בקשה למתן רשות ערעור על החלטת בית המשפט המחוזי בחיפה (השופט ד"ר מ' רניאל) ברת"ק 3005-03-14 מיום 28.5.2014, בה נדחתה בקשת רשות ערעור שהגיש על פסק דינו המשלים של בית המשפט לתביעות קטנות בחדרה. במסגרת ההליך העיקרי, מבלי להגיש בקשה נפרדת כנדרש, ביקש המערער פטור מתשלום אגרה והפקדת עירבון.
2.הרשם דחה את הבקשה לפטור בהחלטה מיום 12.6.2014. בהחלטה זו ציין הרשם כי המערער לא צירף כל תיעוד באשר למצבו הכלכלי, אך קבע שגם אם היה מוכן להניח כי מצבו הכלכלי אינו מן המשופרים, הרי שממילא ההליך העיקרי, בקשת רשות ערעור שעניינה נדון בבית המשפט לתביעות קטנות, הוא הליך שסיכוייו נמוכים מאוד, וזאת נוכח העובדה שתכליתו של בית המשפט לתביעות קטנות – ניהול הליך חסכוני, יעיל ופשוט – עומד בסתירה למבחנים לקבלת ערעור ב"גלגול שלישי" שמחייבים שאלה משפטית בעלת חשיבות כללית. עם זאת, קבע הרשם את העירבון לסכום מתוּן כאמור ברישה.
3.מכאן הערעור שלפניי בו טוען המערער כי לא ייתכן שלאחר שהמשיבה גזלה ממנו סכומי עתק, הוא יידרש לשלם אגרת בית משפט ועירבון לכיסוי הוצאותיה. מלבד האמור, המערער מתייחס בעיקר לשופטת בית המשפט לתביעות קטנות וטוען נגדה.
4.דין הערעור להידחות. ההחלטה העיקרית כלפיה מופנה הערעור ניתנה ביום 12.6.2014. המערער פנה בשתי בקשות לרשם לשם ביטול ההחלטה, ואת הערעור הגיש רק ביום 8.7.2014, כלומר לאחר מועד שנקבע בתקנה 400 לתקנות סדר הדין האזרחי, התשמ"ד-1984, שהוא עשרים יום מיום מתן החלטת הרשם. כיוון שלא שילם והפקיד את הסכומים שנקבעו, מחק הרשם ביום 10.7.2014 את בקשת רשות הערעור שהגיש המערער. משלא הגיש המערער בקשה לעיכוב ביצוע ההחלטה המקורית, ולא שילם או הפקיד את הכספים, אין מקום להשיב את הגלגל לאחור, אלא באמצעות ערעור שמופנה כלפי ההחלטה מיום 10.7.2014.
5.גם לגופו של עניין דין הערעור להידחות. לא מצאתי כל מקום להתערב בשיקול דעתו של הרשם, שהוא כידוע רחב, ולא בנקל תתערב בו ערכאת הערעור (ראו: בש"א 4934/14 גורנשטיין נ' הכנסת, פסקה 13 (21.7.2014) (להלן: עניין גורנשטיין)). אחד משני התנאים המצטברים לקבלת פטור מתשלום אגרה הוא שההליך שהוגש מגלה עילה (שם, בפסקה 6; תקנה 14(ג) לתקנות בתי המשפט (אגרות), התשס"ז-2007). ההליך העיקרי שהגיש המערער הוא בקשת רשות ערעור על בקשת רשות לערער על פסק דין משלים של בית המשפט לתביעות קטנות. הליך שסיכוייו על פני הדברים נמוכים ביותר. יתר על כן, מדובר למעשה גלגול שני של אותו עניין. ראשית נדונה בקשת רשות ערעור שהגיש באותו עניין, התקבלה בחלקה והוחזרה לבית המשפט לתביעות קטנות לשם בירור חיוב כספי אחד מבין חיובים שונים שטען נגד קביעתם (רת"ק 34260-06-13, סגנית הנשיאה (כתארה אז) ש' וסרקרוג, מיום 3.9.2013). עתה כל עניינה של בקשת רשות הערעור הוא באותו סכום כסף למעשה, היות ובאשר לשאר הסכומים – פסק הדין של בית המשפט לתביעות קטנות הפך חלוט, וכך גם רשות הערעור שנתקבלה עליו ונדחתה. קביעותיי אלה לגבי סיכויי ההליך יפות מקל וחומר לעניין העירבון, שלגביו נקבע כי נדרשים סיכויים ממשיים להליך כדי ליתן פטור בהפקדת עירבון במסגרתו (עניין גורנשטיין, בפסקה 11).
6.סוף דבר, הערעור נדחה.
