הנשיאה ד' ביניש:
1.ביום 22.8.2011 ניתן פסק דיננו בבג"ץ 9516/10 מועצת הכפר וולג'ה נ' המפקד הצבאי בגדה המערבית (להלן: עניין הכפר וולג'ה), שעניינו בחוקיות צו תפיסת מקרקעין באזור יהודה ושומרון שמספרו 86/05/ת (להלן: צו התפיסה). כמפורט בפסק הדין, תוואי גדר הביטחון מצוי על קרקעות פלסטיניות של הכפר וולג'ה, אורכו כ- 700 מטר, והוא מחבר את תוואי הגדר באזור הכפר וולג'ה עם התוואי באזור הכפר בתיר.
2.העתירה שלפנינו עוסקת אף היא בחוקיות צו התפיסה האמור, אלא שעניינה בהשגותיה של חברת גבעת יעל בע"מ (להלן: העותרת), הטוענת כי רכשה קרקעות בשטח של כ-2,000 דונם, אשר מחציתן נמצאת למרגלות הכפר הפלסטיני וולג'ה באזור יהודה ושומרון (להלן: האזור). לטענת העותרת, תוואי הגדר פוגע בקניינה באופן שאינו מידתי, שכן הוא מחלק את קרקעותיה ומותיר מאות דונמים מחוץ לשליטתה, בצידו השני של התוואי. העותרת אף הציעה תוואי חלופי להקטנת הפגיעה בקניינה, אשר עיקרו בהסטת תוואי גדר הביטחון דרומה, כך שהכפר וולג'ה והקרקעות המדוברות ייוותרו מצפון לגדר, בצידה ה"ישראלי".
3.בתגובתם המקדמית שללו המשיבים את טענותיה של העותרת בדבר הפגיעה הבלתי מידתית בקניינה. לשיטתם, דין העתירה להידחות הן על הסף מטעמי שיהוי והן לגופה. בתגובתם המקדמית, מעניקים המשיבים דגש מיוחד לשלילת התוואי החלופי אותו מציעה העותרת וטוענים כי זה עתיד לנתק את הכפר הפלסטיני וולג'ה מהאזור ולפגוע קשות במרקם החיים של תושבי הכפר. המשיבים הוסיפו וטענו כי התוואי המוצע סובל מנחיתות ביטחונית מובהקת הנובעת מהותרת הכפר וולג'ה כולו מצידה ה"ישראלי" של הגדר. על כן, היה ויתקבל תוואי חלופי זה, יאלצו המשיבים להקים גדר פנימית שתקיף את הכפר וולג'ה מכל עבריו, באופן שימנע כניסה חופשית ממנו לתוך שטחי ישראל. תוואי כאמור יעצים את הפגיעה הקיימת ממילא בתושבי הכפר וולג'ה, ולכן סבורים המשיבים כי דינו להידחות.
4.ביום 8.2.2011 קיימנו דיון בעתירה שלפנינו ובעתירתה של מועצת הכפר וולג'ה, אף שלא מצאנו לאחדן. עם תום הדיון, הורינו למשיבים לערוך שימוע לעותרת ולעותרים בעניין הכפר וולג'ה ולשקול את אפשרות שינוי התוואי. שימוע כאמור נערך, אלא שגם לאחריו, ולנוכח הטענות שהובאו לעיל, לא מצאו המשיבים לשנות מעמדתם ביחס לתוואי המוצע על ידי העותרת (ראו פסקאות 7-6 לפסק הדין בעניין הכפר וולג'ה).
5.בנסיבות אלה, ובשים לב לקביעותינו בפסק הדין בעניין הכפר וולג'ה באשר לתוואי המעודכן, נחה דעתנו כי המפקד הצבאי נתן דעתו למכלול השיקולים הרלוונטיים לקביעת תוואי גדר הביטחון נשוא העתירה, תוך שהוא מאזן באופן סביר ומידתי בין שלושת אלה: שיקולי ביטחון; החובה לשמור על זכויותיה וצרכיה של האוכלוסייה הפלסטינית; וכן שיקולים שעניינם הגנה על זכויותיה הנטענות של העותרת. אף מצאנו לשוב ולציין, כי על-פי פסיקתו של בית משפט זה, המשמעות שיש ליתן לציפיותיה הכלכליות של העותרת – אפילו אם נניח כי זו תוכיח את זכויותיה בקרקע – באה לידי ביטוי בפגיעה הקניינית; בהתמודדות בין הפגיעה החזיתית בקניין לבין הצורך הביטחוני – האחרון גובר. זו תוצאה בלתי נמנעת מעצם הקמת גדר הביטחון. על כן אין בטענותיה של העותרת בדבר פגיעתו הקשה של התוואי בקניינה כדי להקים עילה להתערבות בתוואי שנקבע (בהקשר זה, ראו: בג"ץ 1361/08 פילדנדרום 12 בע"מ נ' מפקד כוחות צה"ל באזור (טרם פורסם, 10.8.2008), פסקה 10 לפסק דיני).
6.בהתחשב בכל האמור, ולנוכח פסק דיננו בעניין הכפר וולג'ה, מצאנו כי דין העתירה להידחות.
