1.העותר, תושב האזור, מבקש כי תותר יציאתו לחו"ל, וזאת – כדברי העתירה – לצורך השתתפות בטקס הענקת פרס יוקרתי ל"מגיני זכויות אדם".

המדינה מתנגדת לבקשה בשל התנגדותם של גורמי הביטחון. בכתב התשובה הגלוי שהוגש מטעמה נאמר כי העותר הינו פעיל בכיר בארגון טרור, וכי יציאתו לחו"ל עלולה לשמש לקידום פעילות ארגון הטרור באזור.

2.אין זו הפעם הראשונה בה פונה העותר בעתירה הנוגעת לרצונו לצאת מן הארץ. בית-המשפט העליון עיין, במסגרת העתירות הקודמות, וכך עשינו גם אנו היום, בחומר חסוי, שהוצג במעמד צד אחד, מטעם רשויות הבטחון. העתירות נדחו בעבר כולן. כך, בהחלטתו מיום 20.6.2007, מצא בית-המשפט כי "העותר דנא פועל ככל הנראה בבחינת ד"ר ג'קל ומיסטר הייד, בחלק משעות פעילותו הוא מנהל של ארגון זכויות, ובחלק אחר הוא פעיל בארגון טרור שלא בוחל במעשי רצח ובנסיונות לרצח, אשר דבר אין להם עם זכויות, ואדרבה, שוללים הם את הזכות הבסיסית מכולן, זכות היסוד שביסוד, שבלעדיה אין זכויות אחרות – הזכות לחיים". בהחלטתו מיום 7.7.2008, מצא בית-המשפט כי "המ דובר במידע מהימן ולפיו נמנה העותר על פעיליו הבכירים של ארגון הטרור החזית העממית".

3.היום מבקש העותר לשוב ולצאת לחו"ל, לצורך קבלת פרס מטעם ארגון המצוי בהולנד. בא-כוחו ביקשנו להביא בחשבון החלטתנו את הצורך לאזן כראוי בין החשש המובע על-ידי גורמי הבטחון – ואשר לגביו אין לבא-כוח העותר פרטים מספיקים בשל החסיון המגן על החומר העובדתי – לבין זכות היסוד של העותר לנוע חופשי. עמדתם הגורפת של רשויות הבטחון, יש בה, לדעת העותר, משום הפרה של המשפט הבינלאומי ההומניטרי ושל משפט זכויות האדם הבינלאומי. יש להביא בחשבון, לשיטתו של העותר, גם את הזכות המוגברת לתנועה ממנה ראוי שייהנו מגיני זכויות אדם.

4.בשל הנסיבות העובדתיות המיוחדות של המקרה, אין אנו צריכים להידרש לסוגיות העקרוניות החשובות שהעלה העותר. אכן, יש להביא בחשבון בחינת המידתיות הראויה בעמדת המשיב את משקלה של הזכות לחופש התנועה. עם זאת, אין להתעלם גם מן העובדה כי הגדה המערבית כולה היא שטח צבאי סגור, אשר הכניסה והיציאה ממנו טעונים היתר; ממילא הזכות לחופש התנועה נבחנת בראי התחיקה המיוחדת לאזור, שזו, מצידה, נבחנת באספקלריה של המשפט הבינלאומי. כשכל אלה לנגד עינינו, ביקשנו לעשות שתיים אלה: ראשית, לבחון היטב את החומר העובדתי ששימש את המשיב בהחלטותיו. ושנית, לבחון את האפשרות לישב חומר זה עם היתר מתוחם או עם פתרון "יצירתי" המגשים בצורה חלקית את היכולת ליהנות מחופש התנועה. לצורך כך קיימנו שתי ישיבות, אשר בכל אחת מהן נתקיים גם בירור יסודי ומקיף, במעמד צד אחד, ונבחנו האפשרויות לענות בדרך מידתית על אילוצי הבטחון. נסתבר לנו כי החומר המצביע על מעורבותו של העותר בפעילות גופי טרור הוא חומר ממשי ובר סמך. עוד נתברר לנו כי נתווסף חומר שלילי נוסף אודות העותר גם לאחר שנדחתה עתירתו הקודמת. תשתית שלילית זו מאששת את עמדתן של רשויות הבטחון כי האיסור שהוטל על יציאתו של העותר מן הארץ לא נועד לצרכי "ענישה" על פעילותו האסורה, כי אם מתוך שיקולי ביטחון רלבנטיים. כיוון שכך, לא מצאנו דרך להתערב בהחלטות המשיב שלא לאפשר את יציאתו של העותר לחו"ל.

5.בטיעוניו בפנינו התייחס בא-כוח העותר לחריגותה של הפרוצדורה במסגרתה נותן העותר הסכמתו לעיון בית-המשפט בחומר בטחוני חסוי. דיון שכזה, במעמד צד אחד, מקשה ללא ספק על יכולתו של בא-כוח העותר להתמודד עם הטענות המועלות מטעם המשיב. אין ספק כי חריגה זו מכללי הדיון האדברסרי מקשה על מי שמייצג את העותר, הוא מקשה גם על בית-המשפט המבקש לקיים דו-שיח גלוי ויעיל עם נציגי שני הצדדים והיא הופכת, מטבע הדברים, את בית-המשפט, ל"נציגו" של העותר במהלך הדיון החד-צדדי. דרך דיון זו מקשה על הכל – אולם, כפי שהסכים גם בא-כוח העותר, לא זה הפורום ולא זו הדרך להידרש לשאלות החורגות ממסגרת הדיון כאן.

התוצאה היא שהעתירה נדחית. אין צו להוצאות.
