עניינה של העתירה שבפנינו בבקשת העותר, כי נורה למשיב ולמשרדי ממשלה נוספים להשיב באופן מנומק לכל פניותיו אשר נשלחו למשרדים השונים.

העותר הינו אסיר, אשר פנה למשרדי ממשלה שונים ולשירות בתי הסוהר בנושאים שונים. לעתירתו צירף העותר שבע פניות שהגיש למשרד ראש הממשלה, משרד הבריאות, המשרד לביטחון פנים, משרד התעשייה, המסחר והתעסוקה, היועץ המשפטי לממשלה, ושירות בתי הסוהר. לדבריו, פניותיו השונות לא נענו, למעט מכתב שנשלח אליו מאת משרד התקשורת, אשר הודיעו כי פנייתו בנושא עלויות השימוש בטלפונים הציבוריים בבתי הסוהר, התקבלה ותטופל. לדידו, התנהלות זו של הרשויות השונות הינה בלתי סבירה ואינה מידתית, וכן עומדת בניגוד לחוק לתיקון סדרי המינהל (החלטות והנמקות), התשי"ט-1958. העותר מוסיף ומפרט בעתירתו את תוכנה של פנייתו מיום 7.5.2006 למשרד התעשייה, המסחר והתעסוקה, אליה היה מכותב גם משרד התקשורת, בה טען כי תעריפי הטלפון אותם משלמים האסירים על שיחותיהם מבית הסוהר הינם התעריף המקסימאלי. על כן ציין בפנייתו, יש לפתוח את שוק הטלפוניה מבתי הסוהר לתחרות, להוזיל לאסירים את עלויות שיחות הטלפון או לספק לאסירים כרטיסי "טלכרט" ללא תשלום, לצורך מימוש זכויותיהם הצרכניות.

מנגד, המשיב גורס כי דין העתירה להידחות על הסף, לאור קיומו של סעד חלופי. עוד מציין הוא בתגובתו כי נמסר לו מאת שירות בתי הסוהר כי במהלך השנה הקרובה עתיד להתפרסם מכרז, אשר ייתן מענה לסוגיית עלות השימוש בטלפונים הציבוריים בבתי הסוהר.

לאחר עיון בעתירה ובתגובת המשיב, מצאתי כי דין העתירה להידחות על הסף, זאת בשל קיומו של סעד חלופי. סעיף 62א לפקודת בתי הסוהר [נוסח חדש], התשל"ב-1971 (להלן: פקודת בתי הסוהר), מורה כדלקמן:

"(א) אסיר רשאי להגיש לבית המשפט המחוזי שבאזור שיפוטו נמצא בית הסוהר שבו הוא מוחזק (להלן בסימן זה - בית המשפט) עתירה נגד רשויות המדינה ואנשים הממלאים תפקידים על-פי דין בכל ענין הנוגע למאסרו או למעצרו (להלן בסימן זה - עתירה)."

סעיף 62ב לפקודת בתי הסוהר מורה כי אותו בית משפט מחוזי אליו עתר האסיר מוסמך להוציא צווים, המורים לבעלי תפקידים שונים, לעשות מעשים או להימנע מעשייתם, במסגרת מילוי תפקידם. משקיימת ערכאה שיפוטית המוסכמת לדון בעניינו של העותר, לא ייעתר בית משפט זה לבקשתו (ראו בג"צ 3649/08 שמנובה נ' משרד הפנים (לא פורסם, 20.5.2008)).

אמנם, סמכותם של בתי המשפט המנהליים לדון בעתירות מנהליות איננה גורעת מסמכותו של בית משפט זה. עם זאת, כבר עמד על כך חברי השופט גרוניס כי:

"רק במקרים חריגים ונדירים ביותר ייזקק בית משפט זה לעתירות בנושאים המצויים בסמכותו של בית המשפט לענינים מינהליים. הטעם לכך הוא, בין היתר, כי פסק דינו של בית המשפט לענינים מינהליים בעתירה מינהלית נתון ממילא לערעור בפני בית משפט זה בשבתו כבית משפט לערעורים." (בג"צ 2371/04 וולף נ' רשות שדות התעופה בישראל (לא פורסם, 14.3.2004); ראו גם דבריו בבג"צ 4487/08 עמותת רופאים לזכויות אדם נ' מפקד כוחות צה"ל בעזה אלוף פיקוד דרום (לא פורסם, 4.9.2008)).

המקרה שבפנינו איננו נמנה על אותם מקרים חריגים המצדיקים את התערבותנו בשלב זה. לעותר פתוחה הדרך לפנות לבית המשפט המחוזי ולהעלות לפניו את טענותיו השונות המפורטות בעתירתו.

אשר על כן, דין העתירה להידחות על הסף.
