1.העותרים הם בעלי הזכויות בחלקת מקרקעין במערב ראשון לציון (להלן: המקרקעין). בשנת 1973 הוצאו צווי סגירה לפי תקנה 125 לתקנות ההגנה (שעת חירום) 1945 (להלן: תקנות ההגנה), שהוחלו, בין השאר, על המקרקעין, ומאז אותה שנה מחזיקה בהם המדינה. צווי הסגירה הוצאו לצורך הקמת מתקן אימונים המשמש את צה"ל (להלן: המתקן) (לשימוש בתקנות ההגנה לצורך סגירת שטחי אימונים, ראו: דפנה ברק "שטחי אש ושטחי אימונים: ההיבט המשפטי" משפט וצבא 12 153 (1991)). יצוין כי עניינם של העותרים כבר נידון בעבר בבית משפט זה, עת נדחה, ברוב דעות, ערעורם על פסק דינו של בית המשפט המחוזי אשר דחה את תביעתם לתשלום דמי שימוש בהתייחס למקרקעין (ראו: ע"א 2281/06 אבן זוהר נ' מדינת ישראל (28.4.2010) (להלן: עניין אבן זוהר)).

2.העתירה שלפנינו הוגשה ביום 21.4.2013, ובמסגרתה ביקשו העותרים כי בית משפט זה יורה למדינה לבטל את צווי הסגירה האמורים, אשר מכוחם נמנעת מהם הנאה מזכויות הקניין שלהם זה כארבעים שנה. באותו מועד התבקשה המדינה להגיש את תגובתה המקדמית לעתירה, וזו הוגשה לבסוף ביום 3.9.2013. בתגובתה המקדמית ציינה המדינה כי במסגרת בחינה מחדש של כלל צווי הסגירה, החליטו הגורמים הרלוונטיים לגרוע את המקרקעין מן השטחים שלגביהם הוצאו צווי הסגירה, בהתחשב בעובדה שהמקרקעין של העותרים הם חטיבת הקרקע היחידה בבעלות פרטית בתחום עליו הוחלו הצווים. יחד עם זאת, ציינה המדינה בתגובתה כי תהליך גריעתם של המקרקעין כאמור יארך זמן, מאחר שהוא מחייב היערכות מתאימה של צה"ל. המדינה הוסיפה והתייחסה לכך שעל המקרקעין חלות מגבלות תכנוניות שונות המתחייבות מסמיכותם למתקן. המדינה סיכמה את תגובתה בכך שהעתירה התייתרה, וציינה כי תעדכן את העותרים בתוך 45 יום בנוגע ללוחות הזמנים המתוכננים למימוש ההליך של גריעת המקרקעין מתחולתם של צווי הסגירה.

3.ביום 3.9.2013 התבקשו העותרים להגיב לתגובתה המקדמית של המדינה. ביום 30.10.2013 הגישו העותרים את תגובתם, ובה ציינו כי טרם קיבלו לידיהם את לוחות הזמנים האמורים לגבי תהליך גריעתם של המקרקעין מתחום תחולתם של צווי הסגירה. על כן, הם ביקשו כי בית משפט זה יקבע שצווי הסגירה הוצאו שלא כדין, ושהם זכאים לקבלת פיצוי ודמי שימוש לפחות החל ממועד הגשתה של העתירה.

4.בשלב זה, התבקשה המדינה להגיש הודעה מעדכנת שבה תסביר מדוע טרם הועברו לידי העותרים לוחות הזמנים האמורים וכן מתי ייעשה הדבר. לאחר מכן, ניהלו הצדדים משא ומתן מתוך מגמה להביא את המחלוקת ביניהם לסיום, אך למרבה הצער הדבר לא עלה יפה. ההודעה המעדכנת מטעם המדינה הוגשה לבסוף ביום 29.12.2013, ובמסגרתה היא מציינת כי לוחות הזמנים לא הועברו עד כה לידי העותרים עקב המשא ומתן שהתקיים בין הצדדים. לגופו של עניין, הוסיפה המדינה כי התהליך של שינוי ההיערכות מצד צה"ל אשר נועד לאפשר את גריעת המקרקעין מתחולתם של צווי הסגירה יארך כ-18 חודשים.

5.בנסיבות אלה, ניתן לקבוע כי הסעד המקורי שהתבקש בעתירה התקבל למעשה. ככל שפניהם של העותרים לקבלת סעדים אחרים (ובכפוף לאמור בפסק דינו של בית משפט זה בעניין אבן זוהר) – הרי שהליך זה אינו האכסניה המתאימה לכך. על כן, בכפוף להתחייבות המדינה כי המקרקעין ייגרעו מתחולתם של צווי הסגירה עד ליום 1.7.2015, דינה של העתירה להימחק. יש לקוות, כי ככל הניתן, ייעשה מאמץ להשלים משימה זו אף קודם לכן.

6.סוף דבר: העתירה נמחקת. בנסיבות העניין, ומשנראה כי הגשת העתירה תרמה לפעולותיה של המדינה כמפורט לעיל, תישא המדינה בהוצאות העותרים בסך של 10,000 שקל.
