עניינה של העתירה בבקשת העותרים לבטל את צווי ההריסה שהוצאו נגד המבנים שבהחזקתם ולהנפיק למבנים אלה היתרי בניה. עוד מבקשים העותרים להוציא צו ביניים האוסר על ביצוע צווי ההריסה כאמור עד להכרעה בעתירה.

1.נגד המבנים המוחזקים על-ידי העותרים, תושבי כפרים פלסטיניים באזור בקעת הירדן, הוצאו צווי הריסה סופיים, וזאת בשל היותם של המבנים בבחינת בניה בלתי חוקית. בקשתו של העותר 1 להיתר בנייה נדחתה נוכח העובדה שהמבנים שבהחזקתו נבנו בתחום שמורת טבע. לעומת זאת, בקשתו של העותר 2 להיתר בנייה נדחתה בשל היעדר התאמה בין המבנים המוחזקים על-ידו לתכנית שבתוקף וכן בשל היעדר מסמכי בעלות. גם העררים שהגישו שני העותרים, בנפרד, לוועדת המשנה לתכנון ורישוי נדחו.

2.מכאן העתירה שלפנינו. בעתירה טוענים העותרים כי אין לדרוש לצורך קבלת היתר בנייה הוכחת בעלות על הקרקע, אלא די לעניין זה בראיה לכאורה להוכחת זיקה או זכות במקרקעין. בנוסף, נטען כי השטח בו נמצאים המבנים שבהחזקתו של העותר 1 אינו נכלל בשמורת הטבע, וכי מכל מקום ניתן לשנות בקלות את גבולותיה של שמורת הטבע. עוד טוענים העותרים כי מדיניותם של המשיבים באזור יהודה ושמורות פוגעת בזכויות הקניין של התושבים הפלסטיניים בכלל ובזכויותיהם של העותרים בפרט; כי היא לוקה בחוסר סבירות קיצוני; וכי יש בה כדי ליצור אפליה פסולה בין תושבי האזור היהודיים לבין תושבי האזור הפלסטיניים.

3.המשיבים סבורים כי יש לדחות את העתירה על הסף לאור צירוף שני העותרים לעתירה אחת, כאשר הרקע העובדתי לטענותיהם של כל אחד מהעותרים שונה. בהקשר זה מטעימים המשיבים כי העילות שבשלן נדחו בקשות העותרים להיתרי בניה היו שונות, כי ההחלטות בעניינם התקבלו במועדים שונים ובתיקים שונים וכי המרחק הגיאוגרפי בין המבנים שבהחזקת כל אחד מהעותרים הוא מעל 10 ק"מ.

4.הלכה פסוקה היא כי "אין להידרש לעתירה המאגדת בתוכה עניינים שונים ונפרדים, אף מקום בו עלה בהן נושא בעל אופי דומה" (בג"צ 2608/06 המועצה המקומית מטה אשר נ' שר הפנים, תק-על 2006(2) 2776, 2777 (2006); בג"צ 11252/05 זפטונבה נ' מפקד כוחות צה"ל בגדה המערבית, תק-על 2005(4) 3093 (2005)). אכן, עניינם של שני העותרים שונה, הן בשל העילות השונות בגינן בקשותיהם להיתרי בניה נדחו והן בשל המרחק הגיאוגרפי בין המבנים מושאי טענות העותרים. הבדלים אלה מצביעים על כך שעניינם של כל אחד מהעותרים עשוי לעורר היבטים עובדתיים ומשפטיים שונים תוך יצירת סרבול מיותר בדיון בעתירה (בג"צ 4922/03 ג'בארין נ' שר הפנים, תק-על 2003(2) 2024 (2003)). משכך, במקרים כגון דא דין העתירה להידחות, וזאת מבלי לפגוע בזכות העותרים להגיש עתירות נפרדות (בג"צ 4882/03 ג'בארין נ' שר הפנים, תק-על 2003(2) 2172 (2003); בג"צ 2336/05 חליפה נ' שר הפנים, תק-על 2005(4) 1917, 1918 (2005)).

5.יצוין כי בהחלטתי מיום 26.6.13 ניתנה לעותרים הזדמנות, לפנים משורת הדין, להפריד את עניינו של אחד מהם לעתירה אחרת. משלא התקבלה הודעה כלשהי מטעם בא-כוח העותרים בתקופה שהוקצבה לו לשם לכך, אין לנו אלא לדחות את העתירה על הסף נוכח כל האמור.

לפיכך, העתירה נדחית על הסף. שמורה לעותרים הזכות להגיש עתירות נפרדות. העותרים יישאו בהוצאות המשיבים בסך כולל של 3000 ₪. משהוחלט על דחיית העתירה, ממילא התייתר הצורך לדון בבקשת העותרים לצו ביניים.
