עתירה בעניין מניעת מפגש של העותר עם עורך-דין על פי צווים שהוצאו לעניין זה על ידי המשיב מתוקף הסמכות הנתונה לו בסעיף 58(ד) לצו בדבר הוראות ביטחון [נוסח משולב] (יהודה והשומרון) (מס' 1651), התש"ע-2009.

העותר נעצר ביום 11.8.2013 בחשד לקשירת קשר לביצוע פשע במטרה לפגוע בביטחון המדינה ומעצרו הוארך לאחרונה עד ליום 2.9.2013. במהלך המעצר ובשל צורכי החקירה, הוצא ביום 25.8.2013 צו המונע את פגישתו של העותר עם עורך-דין. צו זה עמד בתוקפו עד יום 25.8.2013 בשעה 23:59 ובאותו היום (25.8.2013) הוצא על ידי המשיב צו נוסף המונע את פגישתו של העותר עם עורך-דין עד ליום 28.8.2013 בשעה 23:59.

העתירה שבפנינו התייחסה במקורה לצו זה, אך במהלך היום עדכן המשיב לבקשתנו כי הוחלט להאריך את צו מניעת הפגישה בעניינו של העותר בשלושה ימים נוספים בשל צורכי החקירה, דהיינו עד יום 31.8.2013 בחצות.

בהסכמת בא-כח העותר עורך-הדין אשרף עיינו בחומר חסוי ושוכנענו כי יש בנסיבות העניין הצדקה לצו שהוצא משיקולים של טובת החקירה וכי אין עילה להתערב בו.

אשר על כן, העתירה נדחית.
