עניינה של העתירה שלפנינו בבקשת העותר כי נורה למשיבים לבוא וליתן טעם לסירובם לרשום הערת התנגדות אודות קיומה של פסיקתא בת"א 9477/07 (מחוזי ירושלים), ביחס למספר חלקות בכפר ערב אל-סואחרה (להלן: המקרקעין).

1.לטענת העותר, הוא פנה לרשם מקרקעין מעלה אדומים (להלן: הרשם) בבקשה לרשום הערה אודות קיומה של הפסיקתא שניתנה לטובתו – ולפיה ביחסים בינו לבין מוכר המקרקעין העותר הינו הבעלים או הזכאי להירשם כבעלים של המקרקעין – אך בקשתו נענתה בשלילה בניגוד לדין ולפרקטיקה המקובלת.

2.המשיבים טוענים בתגובה כי דין העתירה להידחות על הסף בהעדר עילה להתערבות בהחלטת הרשם. עוד נטען כי העותר נמנע מלצרף לעתירה את מר מוחמד אלערג' ומר אחמד עלי, שעל שמם קיים רישום מס רכוש הנוגע למקרקעין והם עלולים להיפגע מקבלת העתירה, וגם מטעם זה יש לדחות את העתירה על הסף. בהקשר זה ציינו המשיבים כי נסח מס רכוש הינו עותק של ספר המס החקלאי, שהועבר לרשות הפלסטינית במסגרת הסכם ביניים ישראלי-פלסטיני משנת 1995, ולפיכך אין בסמכותו של הרשם לשנות או להוסיף על הרישומים הקיימים בנסח המס.

המשיבים הבהירו כי בהיעדר מוסד מקביל למוסד 'הערת אזהרה' בדין החל באזור יהודה ושומרון, קיימת פרקטיקה של שימוש ב'הערת התנגדות' במרשם המקרקעין באזור, אשר לה מעמד מינהלי גרידא. אלא שרישום כאמור מתאפשר ביחס למקרקעין רשומים בלבד, בעוד המקרקעין דנן אינן רשומים ואינם מוסדרים. המשיבים הוסיפו כי פתוחה בפני העותר הדרך להגנה על זכויותיו הנטענות על ידי הגשת בקשה להיתר ורישיון לעסקה, וככל שיינתן הרישיון, לנקוט בהליך רישום ראשון של המקרקעין.

3.דין העתירה להידחות על הסף, באשר אינה מגלה עילה המצדיקה התערבותו של בית המשפט הגבוה לצדק בהחלטת הרשם. ככל שהעותר מעוניין להגן על זכויותיו, פתוחה בפניו הדרך, כפי שהבהירו המשיבים, להגיש בקשה להיתר עסקה, כפי שמתחייב בהתאם לצו בדבר עסקאות במקרקעין (אזור יהודה והשומרון) (מס' 25) התשכ"ז-1967. אם וככל שתוגש בקשה להיתר, יעודכן העותר אם וכאשר גורמים נוספים יבקשו לעשות פעולות במקרקעין (ראו ע"א 9694/10 אח ראש (אלקנה) בע"מ נ' אחוזת שומרון (אלקנה) בע"מ, פסקה 8 (10.3.2011)). העותר לא עשה כן ובמובן זה העתירה לוקה באי מיצוי הליכים.

4.דין העתירה להדחות על הסף גם בשל אי צירוף צדדים שעלולים להיפגע מקבלת העתירה. כאמור, לגבי המקרקעין קיים רישום במס רכוש על שמם של מר מוחמד אלערג' ומר אחמד עלי, רישום אשר מהווה ראשית ראיה להוכחת זכויות בהליכי רישום ראשון ביהודה ושומרון (ראו תקנה 3(א)(3) לתקנות רישום נכסי דלא ניידי אשר טרם נרשמו (בקשות לרישום] התשס"ט-2008; ערר (ועדת ערר אזור יהודה ושומרון) 129/12 אלעאידון ללעקראת (טלמון) בע"מ נ' קמ"ט רישום מקרקעין, פסקה 3 (30.6.2013). אודות הסדר זכויות במקרקעין באזור יהודה ושומרון ראו חיים זנדברג הסדר זכויות במקרקעין בארץ-ישראל ובמדינת ישראל 354-353 (2000); אייל זמיר אדמות המדינה ביהודה ושומרון סקירה משפטית 27 (1985)). הלכה היא כי על העותר ל בית המשפט הגבוה לצדק לצרף כמשיבים את כל מי שזכויותיהם עלולות להיפגע מקבלת הסעד המבוקש (ראו לדוגמה בג"ץ 1901/94 לנדאו נ' עיריית ירושלים, פ"ד מח(4) 403, פסקאות 8, 18 (1994); בג"ץ 8122/11 עיריית ירושלים נ' הרשות השנייה לטלוויזיה ולרדיו, פסקה 5 (21.12.2011)).

למעלה מן הצורך אציין כי העותר אף לא צירף את פנייתו לרשות ואת המענה לפנייתו כפי שוודאי ראוי היה שיעשה, ולא הצביע על אסמכתא התומכת בטענתו כי קיימת פרקטיקה של רישום הערת התנגדות במקרקעין לא רשומים.

5.סוף דבר, דין העתירה להידחות מן הטעמים המפורטים. העותר ישא בהוצאות המשיבים בסך 3,000 ₪.
