1.בעתירה שבפנינו טוען העותר 1 כי המשיב ביקש לשנות באופן יזום ובכפייה את כתובתו במרשם האוכלוסין מהעיר העתיקה בירושלים לשכונת כפר עקב בירושלים, ועתר לכך שתעודת הזהות שלו תחודש מבלי שכתובתו תשונה כאמור. לטענת העותר 1 גיבש המשיב את עמדתו בעניין זה לאחר שלושה שימועים שערך לו ביום 29.11.2010, ועל כן סורבה בקשה שהגיש לחידוש תעודת הזהות. כמו כן ביקשו העותרים כי שינוי כתובתם של תושבי מזרח ירושלים ייעשה בלא שיופלו לרעה אל מול יתר תושבי המדינה.

2.ביום 25.5.2012, כשבעה חודשים לאחר הגשת העתירה, הודיע המשיב כי בעקבות מידע נוסף שהתקבל בנוגע למקום מגוריו של העותר 1, הוחלט לערוך לו שימוע נוסף ביום 5.6.2012 ובתגובה מקדמית שהגיש ביום 28.6.2012 ציין המשיב כי לאחר השימוע כאמור נבחן מלוא המידע הרלבנטי בעניינו של העותר ונמצא כי חל שינוי נסיבות ועל כן אין מקום, בעת הזו, לשנות את מענו של העותר 1 במרשם האוכלוסין. עוד ציין המשיב כי אין ולא היתה גם בעבר כל מניעה לחידוש תעודת הזהות של העותר 1, והוסיף וטען כי בנסיבות אלו העתירה התייתרה ודינה להימחק.

3.העותרים מצידם הודיעו כי הם מסכימים למחיקת העתירה וציינו כי שמשחזר בו המשיב מהחלטתו בדבר שינוי כתובתו של העותר 1, התייתרה העתירה בהקשר זה. עוד ציינו העותרים כי הטענה הנוספת שהעלו לפיה יש להחיל מדיניות שוויונית בעניין שינוי כתובות על כלל תושבי המדינה לרבות תושבי מזרח ירושלים, קיבלה מענה בפסק דין שניתן לאחרונה (בג"ץ 6825/07 אבו רמילה נ' שר הפנים (טרם פורסם, 28.5.2012) (להלן: עניין רבו רמילה)). עם זאת הוסיפו העותרים כי המשיב הדגיש בתגובתו שהוא ניאות שלא לשנות את כתובתו של העותר 1 באופן זמני בלבד ("לעת הזו") ובשל כך עמדתו מעוררת קושי. על כן ציינו המבקשים כי הם שומרים על מלוא טענותיהם בעניין זה וכן באשר לטענת ההפליה של תושבי מזרח ירושלים אשר אליה ואל הקביעות בעניין אבו רמילה נמנע המשיב מלהתייחס. לבסוף ציינו העותרים כי כיוון שהסעד הפרטני לו עתרו ניתן להם רק בעקבות הגשת העתירה יש להשית על המשיב את ההוצאות ואת שכר-הטרחה שבהם נשאו.

4.משבא העותר 1 על סיפוקו, כמבואר לעיל, העתירה התייתרה והיא נמחקת. עם זאת, העותר 1 נאלץ להגיש את העתירה שבכאן על מנת לקבל את מבוקשו. בהתחשב בכך ובהתחשב בזמן הממושך שנדרש למשיב להגיע להחלטה גם לאחר הגשת העתירה (שמונה חודשים), ישא המשיב בהוצאות האגרה ששילם העותר 1 וכן בשכר טרחת עורך-דינו בסך של 3,000 ש"ח.
