השופט י' אלון:

1.רשות המסים פירסמה "נוהל גילוי מרצון". על פי הנוהל, נישום "שיגלה מרצון, בפניה כנה שלא נעשתה בעקבות חקירה או בדיקה המתבצעת על ידי רשות המסים" – לא יינקטו כנגד הפונה הליכים פליליים.

העותרת, כנטען בעתירתה, גילתה ביום 15/7/07 כי מי שכיהן כמנכ"ל שלה ביצע ללא הרשאתה רישומים בלתי תקינים בספריה אשר גרמו לתשלומי מע"מ בסכומים מופחתים משמעותית מסכומי המס שחייבת היתה לשלמם. המ דובר בעשרות מיליוני ש"ח. לטענת העותרת, מיד כשנתגלו לה הדברים היא הפסיקה את עבודת המנכ"ל ופנתה מיוזמתה באמצעות נציגיה לרשות המסים, גילתה את דבר מימצאיה הנ"ל, וביקשה כי יוחל בענינה נוהל הגילוי מרצון. רשות המסים סירבה להחיל הנוהל בענינה ופתחה בהליכי חקירה גלויה.

בעתירה זו עותרת היא כי נורה לרשות המסים לבטל החלטתה האמורה ולהחיל על העותרת את "נוהל הגילוי מרצון" תוך קביעת חסינותה מהליכים פליליים כקבוע באותו נוהל.

2.המשיבים בתגובתם לעתירה טוענים כי נוהל הגילוי מרצון אינו חל בענינה של העותרת.

המ דובר בחקירה סמויה שרשות המסים החלה בה מספר חודשים בטרם פנתה אליה העותרת באותו הגילוי ביולי 2007. החקירה, שבינתיים נעשתה גלויה, מסועפת ומורכבת והנתונים אותם גילתה העותרת מתייחסים לקטעים ספורים ממכלול הנושאים הנחקרים.

המשיבים מוסיפים וטוענים בתגובתם כי מתוך נתוני החקירה עד כה עולים סימני שאלה משמעותיים לענין כנות הפניה של העותרת וכי מטרתה בעתירה זו אינה אלא לעכב את הליכי החקירה המסועפת המצויים בעיצומם.

לטענת המשיבים, דחיתם את בקשת העותרת להחיל עליה את נוהל הגילוי מרצון נובעת מתוך התנאים הקבועים בנוהל עצמו ומאי עמידת העותרת בתנאים הנדרשים להגדרת וסיווג פנייתה כ"גילוי מרצון" במשמעות הנודעת לו באותו נוהל.

3.טענה נוספת של המשיבים בתגובתם לעתירה הינה כי דין העתירה להידחות על הסף.

זאת מאחר ועומדים לרשות העותרת הסעדים החלופיים בדרך הפניה לבתי המשפט הדנים בהליכים שיבקשו לאחוז כנגדם המשיבים במהלך פעולות החקירה, ואם יגיעו הדברים להגשת כתב אישום – בפני בית המשפט בפניו יתנהלו הליכי המשפט.

4.לאחר בחינת העתירה ותגובת המשיבים, על צרופותיהן, מצאנו כי אכן דין העתירה להדחות על הסף מטעם זה של קיום הסעדים החלופיים.

ככלל, הפורום הראוי לבירור טענות של נחקרים או חשודים שטרם הואשמו – לענין כשרותם של הליכי חקירה או פגמים שנפלו בה לטענתם – הינו בבית המשפט הדן בהליכים הקודמים להגשת כתב האישום.

אם יוגש כתב אישום יהיה הפורום הנאות לבירור טענות אלה בבית המשפט הדן בהליך הפלילי גופו.

פתיחה מקבילה של שערי בית משפט זה לבירור אותן הטענות תיצור בהכרח פיצול דיונים מיותר והתמשכות הליכים שלא לצורך (ראו עע"מ 3518/02 רג'בי נ' יושב-ראש הוועדה המקומית לתכנון ולבניה ירושלים, פ"ד נז(1) 196 (2002)).

בנוסף, בירור טענות אלה כרוך בדרך כלל, ומעצם טיבו, במחלוקות עובדתיות שבירורן הראוי והנכון הינו דווקא בערכאה הדיונית (ראו בג"ץ 9131/05 ניר עם כהן ירקות אגודה שיתופית חקלאית בע"מ נ' משרד התעשייה המסחר והתעסוקה (טרם פורסם, 6.2.06)). ואמנם, עיון בעתירה דנן ובתגובת המשיבים לה מעלה על פניו מחלוקות עובדתיות רבות השוררות ביניהן לענין ה"גילוי מרצון" בנסיבות הנטענות על ידי העותרת מחד גיסא, ואי עמידתו של אותו הגילוי בתנאי הנוהל שבנדון כנטען על ידי המשיבים מאידך גיסא.

נמצא איפוא כי לא זו בלבד שעומדים לעותרת הסעדים החלופיים האמורים, אלא שבית המשפט הגבוה לצדק וסדרי הדין הקבועים בו איננו הפורום הנאות מעיקרא לבירור וליבון טענות העותרת שבעתירה זו (וראו עוד לענין זה – בג"ץ 11099/04 ורצברגר נ' היועץ המשפטי לממשלה (טרם פורסם, 6.1.05)).

5.מן הטעמים שפירטנו לעיל – החלטנו לדחות את העתירה על הסף.
